Ways of labelling court actions, considerations and decisions as a translation problem

Abstract

Данная работа посвящена проблеме перевода глагольных терминов с семантикой «мысли», «суждения», «цитирования», «свидетельства», регулярно использующихся в текстах решений, выносимых судами по гражданским делам первой инстанции Франции и России. Данное исследование должно определить критерии, ограничивающие употребление таких терминов. Проводится семантический, синтаксический и функциональный анализ терминов, означающих акты говорения, свидетельствования и суждения. Выявляются факторы неполной синонимии между отобранными единицами в обоих языках (семантика актанта, часть судебного решения, актантная структура предиката, дискурсивная устойчивость конструкции). Регулярность употребления тех или иных глаголов как во французском, так и в русском судебном дискурсе, а также невозможность замены большинства из них на синонимичные единицы, свидетельствует о терминологическом статусе этих единиц. Предлагаются переводческие решения, учитывающие норму юридического дискурса в языке перевода. Также обнаружено, что французский судебный дискурс располагает большим количеством глагольных единиц со значением суждения, говорения и свидетельствования, чем русский судебный дискурс, что следует учитывать в ситуации перевода. Данное исследование показывает целесообразность применения вышеупомянутого метода анализа для оптимизации переводческого процесса. Выносится предположение о необходимости продолжения данной работы на более широком языковом материале (на материале судебного дискурса в других отраслях права и других инстанций).

This paper focuses on the problem of translation of verbal terms with the semantics of "thought", "judgement", "citation", "evidence" regularly used in the texts of judgments rendered by civil courts of first instance in France and Russia. This study shall identify the criteria limiting the use of such terms. A semantic, syntactic and functional analysis of the terms denoting the acts of speaking, testimony and judgment is carried out. The factors of incomplete synonymy between the selected units in both languages are identified (the semantics of the actant, the part of the judgment, the actant structure of the predicate, the discursive stability of the construction). The regularity of the use of certain verbs in both French and Russian judicial discourse, as well as the impossibility to replace most of them with synonymous units, indicates the terminological status of these units. Translation solutions that take into account the norm of legal discourse in the target language are proposed. It is also found that French judicial discourse has more verb units with the meaning of judgment, speaking and testifying than Russian judicial discourse, which should be taken into account in the translation situation. This study shows the feasibility of applying the above-mentioned method of analysis to optimise the translation process. It is suggested that this work should be continued in a broader linguistic material (judicial discourse in other branches of law and other instances).
