Анализ действующей организационно-правовой модели досудебного порядка обжалования актов и действий (бездействия) налоговых органов и их должностных лиц в связи с изменениями налогового законодательства, вследствие которых модель обжалования стала носить обязательный характер. 2. Выявление потенциальной возможности конфликта при реализации модели налогового обжалования, созданной в структуре Федеральной налоговой службы России и предполагающей рассмотрение жалобы в вышестоящем налоговом органе, между базовым принципам объективности и независимости обжалования, как неотъемлемыми принципами административно-юрисдикционной деятельности органов государственной власти, и интересом в сохранении собственной репутации системы налоговых органов, которая является единой и централизованной. 3. Анализ возможных путей решения проблем соотношения субординации и обязательного досудебного обжалования актов налоговых органов в системе налоговых органов в Российской Федерации и иных странах. Выводы, сделанные по результатам исследования: 1. Понятие налоговой жалобы в действующем законодательстве сформулировано через категорию обращения, что не подразумевает под собой материально-правовой аспект обжалования, а именно право на рассмотрение жалобы. Таким образом, в первой главе диссертационного исследования отмечена необходимость дополнить определение налоговой жалобу путем указания на то, что жалоба помимо обращения в соответствующий орган подразумевает под собой материально-правовое требование налогоплательщика о ее рассмотрении. 2. В ходе исследования было выявлено отсутствие надлежащей теоретической разработанности и нормативной урегулированности системы административного процесса, что выражается в отсутствии четкого разделения между понятиями административной юрисдикции и административной юстиции. Учитывая, что налоговая жалоба имеет в своей основе административно-правовой спор между налогоплательщиком и государством в лице налоговых органов, возникающий из экономических отношений, и является предметом административно-процессуальной деятельности органов государственной власти, для конструирования модели обжалования надлежащим образом, необходимо иметь хорошо разработанную теоретическую базу, поскольку налоговое обжалование должно укладываться в базовые теоретические принципы той стадии административного процесса, в рамках которой оно осуществляется. 3. В действующей системе регулирования заложен конфликт между неотъемлемыми принципами объективного и справедливого рассмотрения административной жалобы и стремлением к сохранению собственной репутации единого централизованного органа – Федеральной налоговой службы Российской Федерации. Анализ действующего законодательства показал фрагментарную урегулированность механизма административного обжалования, частичное восполнение которого долгое время происходило за счет внутренних актов Федеральной налоговой службы, которые использовались в отсутствии возможности ознакомления с ними налогоплательщиком. Анализ решений по жалобам налогоплательщиков, принимаемых УФНС по субъектам показал, что налоговые органы, представляя собой единую централизованную систему, зачастую связаны единой позицией и не свободны от ведомственного предубеждения. 4. Также было выявлено, что существующая модель налогового обжалования, безусловно, достигает цель осуществления контроля вышестоящими налоговыми органами за деятельностью нижестоящих, поскольку все спорные вопросы как материального, так и процессуального характера анализируются в порядке досудебного налогового производства в службе налогового аудита вышестоящего налогового органа. Однако осуществление подобных контрольных и аналитических мероприятий должно осуществляться не за счет ущемления прав и гарантий налогоплательщика, который по определению во взаимоотношениях с органами государственной власти занимает более слабую сторону 5. Существующее подразделение налогового аудита, полномочиями которого является рассмотрение жалоб налогоплательщиков на акты нижестоящих налоговых органов, действия (бездействие) их должностных лиц в связи с осуществлением налоговыми органами полномочий, по результатам рассмотрения которых выносится решение, подготовка по запросу Федеральной налоговой службы России заключений по жалобам, рассмотрение возражений (разногласий) налогоплательщиков (налоговых агентов, плательщиков сборов) по актам повторных выездных налоговых проверок, назначенных и проведенных управлением ФНС России по субъекту РФ, по результатам, рассмотрения которых подготавливается экспертное заключение об обоснованности (необоснованности) доводов налогоплательщика, находится в системе функциональной подчиненности налоговых органов, следовательно, наличие специализированного подразделения не снимает вышепоставленную проблему. 6. В зарубежных странах активно используется механизм медиации при разрешении конфликтов в налоговой сфере, что позволяет прийти к компромиссному решению в отношении объема налоговой обязанности налогоплательщика. Диссертантом был сделан вывод о том, что российский правопорядок не готов к появлению института медиации для разрешения налоговых споров, поскольку налоговое право является публичной отраслью с императивными методом регулирования, следовательно разрешение конфликта путем достижения договоренности предметом которой является объем налоговой обязанности налогоплательщика представляется трудно допустимой. Более того, санкции в налоговом законодательстве за неисполнение налоговой обязанности сконструированы как процент от основной суммы задолженности, что приведет к определению путем соглашения с налоговыми органами не только объема налоговой обязанности, но и объема публичной ответственности за допущенное налоговое правонарушение. 7. Анализ моделей досудебного обжалования показал следующие варианты его конструирования: обжалование актов и действий (бездействия) налоговых органов в квазисудебных органах, обжалование в подразделении налогового органа, которое формально входит в него, но имеет раздельную линию подчиненности и является независимым. 8. Диссертант пришел к выводу о необходимости выведения административно-юрисдикционной деятельности по рассмотрению жалобы налогоплательщика на акты налоговых органов, принимаемых по результатам проверок или на действия (бездействие) должностных лиц налоговых органов в самостоятельную, функционально неподчиненную административную службу. Такая организационно-правовая модель позволит обеспечить реализацию субъективного права налогоплательщика на предъявление жалобы и материально-правового требования ее рассмотрения в административном порядке на основе принципов объективности, независимости и беспристрастности. В тоже время это позволит сохранить такие преимущества административного обжалования, как скорость рассмотрения и бесплатность, а также позволит снизить нагрузку судов, тем более, как было отмечено выше, в конечном итоге необходимо прийти к максимальному количеству разрешения налогово-правовых споров на досудебном этапе, а деятельность судебных органов преимущественно осуществлять в рамках контроля за деятельностью органов исполнительной власти.

Conclusions drawn from the study: 1. The concept of a tax complaint in the current legislation is formulated through the category of treatment, which does not imply the substantive aspect of the appeal, namely the right to consider the complaint. Thus, in the first chapter of the dissertation research, it is noted that it is necessary to supplement the definition of a tax complaint by pointing out that in addition to applying to the relevant body, the complaint implies a material and legal requirement of the taxpayer to consider it. 2. In the course of the study, it was revealed that there is a lack of proper theoretical elaboration and normative settlement of the administrative process system, which is expressed in the absence of a clear division between the concepts of administrative jurisdiction and administrative justice. Taking into account that the tax complaint is based on the administrative and legal dispute between the taxpayer and the state represented by the tax authorities arising from economic relations and is the subject of administrative and procedural activity of the state authorities, it is necessary to have a well-developed theoretical Basis, since the tax appeal should fit into the basic theoretical principles of that stage of the administrative process, x which they occur. 3. In the current regulatory system, there is a conflict between the inalienable principles of an objective and fair consideration of an administrative complaint and the desire to preserve the reputation of a single centralized body - the Federal Tax Service of the Russian Federation. An analysis of the current legislation showed a fragmented settlement of the mechanism of administrative appeal, a partial replenishment of which for a long time was due to internal acts of the Federal Tax Service, which were used in the absence of the opportunity to become acquainted with them by the taxpayer. Analysis of decisions on complaints of taxpayers taken by the Federal Tax Service for the subjects showed that the tax authorities, representing a single centralized system, are often linked by a single position and are not free from departmental bias. 4. It was also revealed that the existing tax appeal model, of course, achieves the goal of controlling higher-level tax authorities for the activities of subordinates, since all disputable issues, both material and procedural, are analyzed in the pre-trial tax procedure in the tax audit service of a higher tax authority. However, the implementation of such control and analytical measures should not be carried out at the expense of infringement of the rights and guarantees of the taxpayer, which by definition, in relations with public authorities, takes the weaker side 5. Existing subdivision of the tax audit, whose powers are to examine the complaints of taxpayers against acts of lower tax authorities, actions (inaction) of their officials in connection with the exercise by the tax authorities of the powers, upon the results of consideration of which a decision is made, preparation of conclusions on the request of the Federal Tax Service of Russia complaints, objections consideration (differences) of taxpayers (tax agents, payers of fees) for the repeated acts of exit tax check Assigned and carried out management Russian Federal Tax Service of the Russian Federation subject, the results of the examination of which is prepared by an expert opinion about the validity of the (unfounded) the taxpayer's arguments,Based on the results of consideration of which an expert opinion is prepared on the validity (unreasonableness) of the taxpayer's arguments, is in the system of functional subordination of the tax authorities, therefore, the presence of a specialized unit does not remove the above problem. 6. In foreign countries, the mediation mechanism is actively used in resolving conflicts in the tax sphere, which allows reaching a compromise solution with regard to the amount of the tax liability of the taxpayer. The thesis concluded that the Russian legal order is not ready for the emergence of a mediation institute for resolving tax disputes, since the tax law is a public industry with an imperative method of regulation, therefore the resolution of the conflict by reaching agreement with the subject of which is the scope of the taxpayer's tax obligation seems difficultly admissible. Moreover, the sanctions in the tax legislation for non-fulfillment of the tax liability are designed as a percentage of the principal amount of debt, which will lead to determining, by agreement with the tax authorities, not only the amount of the tax duty, but also the amount of public responsibility for the tax violation committed. 7. Analysis of models of pre-trial appeal showed the following options for its design: appealing against acts and actions (inaction) of tax authorities in quasi-judicial bodies, appealing to a subdivision of the tax authority that formally enters into it, but has a separate line of subordination and is independent. 8. The candidate came to the conclusion that it is necessary to remove administrative-jurisdictional activity for consideration of a taxpayer's complaint against acts of tax authorities that are taken as a result of inspections or actions (inaction) of officials of tax authorities in an independent, functionally disconnected administrative service. Such an organizational and legal model will ensure the implementation of the subjective right of the taxpayer to present a complaint and a material and legal requirement for its consideration in an administrative order on the basis of the principles of objectivity, independence and impartiality. At the same time, this will allow to preserve the advantages of administrative appeal, such as speed of consideration and free of charge, and also will reduce the load of ships, especially as it was mentioned above, ultimately it is necessary to come to the maximum amount of resolution of tax disputes at the pre-trial stage, and The activities of the judiciary are primarily carried out within the framework of control over the activities of executive bodies.
