The comparison of court decisions on freedom of religion in the European Court of Human Rights and the Constitutional Court of the Russian Federation

Abstract

Право на свободу совести и свободу религии традиционно рассматривается в числе основных прав человека, оно закреплено в Конституции Российской Федерации, «Всеобщей декларации прав человека», «Европейской конвенции о защите прав человека и основных свобод». Значение данного права для каждого человека невозможно переоценить. В связи с тем, что практика как Европейского Суда по правам человека, так и Конституционного Суда Российской Федерации по вопросам связанным с правом на свободу совести и свободу религии, достаточно обширна, согласованность позиций указанных органов является важным гарантом защиты права человека на свободу совести и свободу религии. Данная работа посвящена изучению следующих вопросов: определено нормативное содержание права на свободу совести и свободу религии, закрепленного в Европейской Конвенции о защите прав человека и основных свобод и в Конституции Российской Федерации; исследован вопрос об особенностях толкования права на свободу религии Конституционным Судом Российской федерации и Европейским Судом по правам человека; а также рассмотрены рассмотрение отдельных аспектов права на свободу совести и свободу религии в практике Конституционного Суда Российской Федерации и Европейского суда по правам человека. Изучение данный вопросов позволило провести сравнительный анализ подходов Конституционного Суда Российской Федерации и Европейского Суда по правам человека к вопросам реализации права на свободу религии.

The right to freedom of conscience and freedom of religion was traditionally viewed as a fundamental human right, enshrined in the Constitution of the Russian Federation, "the universal Declaration of human rights", "European Convention for the protection of human rights and fundamental freedoms". The value of this right for every human cannot be overemphasized. Due to the fact that the practice of European Court on human rights and constitutional Court of the Russian Federation on issues related to the right to freedom of conscience and freedom of religion, is quite extensive, the consistency of the positions of these bodies is an important guarantor for the protection of human rights on freedom of conscience and freedom of religion. This work is devoted to study the following issues: the normative content of the right to freedom of conscience and freedom of religion enshrined in the European Convention for the protection of human rights and fundamental freedoms and in the Constitution of the Russian Federation; the questions about the features of the interpretation of the right to freedom of religion the Constitutional Court of the Russian Federation and the European Court of human rights; and the consideration of individual aspects of the right to freedom of conscience and freedom of religion in the practice of the constitutional Court of the Russian Federation and the European court of human rights. The study of the questions allowed a comparative analysis of the approaches of the constitutional Court of the Russian Federation and the European Court of human rights on the implementation of the right to freedom of religion.
