Mediation as a procedure and as a technology

Abstract

Данная работа посвящена исследованию различных медиативных техник, стилей, целей и задач каждой медиативной стадии, являющихся технологической составляющей медиации и нормативных правовых актов, определяющих ее процедурную основу.

Предметом данной работы является процедура и технология, как составляющие медиации, а объектом – медиация.

Актуальность данной работы определяется необходимостью исследования медиации с различных сторон, для того чтобы глубже изучить механизм работы медиатора и выявить особенности, которые могут быть связаны с процедурной или технологической частью процесса, так как интерес к нему в последнее время активно возрастает.

Целью данной работы является выявление технологических и процедурных особенностей медиации и проблем, которые они могут за собой повлечь. Задачей, в свою очередь, анализ различных научных источников в области медиации, используемых в России.

В ходе проделанной работы были выявлены терминологические особенности медиации, исследованы нормативные правовые акты регулирующие медиации в России, а также различные техники, стили и классификации медиации, что позволяет в полной мере описать процедурную и технологическую составляющие данного процесса.

This graduation work is devoted to the research of different mediation techniques, styles, goals and objectives of each mediation stage, which are part of the technological component of mediation process and laws defining its procedural framework.

The subject of this work is the procedure and technology, as components of the mediation and the subject is mediation.

The relevance of this work is determined by the need of studying mediation from various sides of it in order to learn more about the mechanisms which mediator uses in his work and to identify characteristics that may be associated with procedural and technological part of the process, because mediation is becoming more popular.

The aim of this work is to identify the technological and procedural features of mediation and the problems they can cause for themselves. The main task, in turn, is analyzing various scientific sources of mediation used in Russia.

In the course of this work we identified terminological differences of mediation, the normative legal acts regulating mediation in Russia, as well as different techniques, styles and classifications of mediation that allows to fully describe the procedural and technological components of the process of mediation.
