Status and powers of the Court of the Eurasian Economic Union

Abstract

САНКТ-ПЕТЕРБУРГСКИЙ ГОСУДАРСТВЕННЫЙ УНИВЕРСИТЕТ АННОТАЦИЯ выпускной квалификационной работы студента магистратуры по программе «Международное право» Пасечкиной Алены Тема диссертации: «Статус и полномочия Суда Евразийского союза» Цели и задачи исследования: - определить роль и функции Суда Евразийского экономического союза (далее - Суд ЕАЭС) в евразийском интеграционном процессе; - проанализировать правовую основу функционирования Суда ЕАЭС; - выявить особенности правового статуса судей Суда ЕАЭС; - провести анализ компетенции Суда ЕАЭС. Выводы, сделанные по результатам исследования: - Суд ЕАЭС не связан формальными отношениями правопреемства с Судом ЕврАзЭС. В то же время Суд ЕАЭС, несомненно, может считаться продолжателем Суда ЕврАзЭС - точно так же, как ЕАЭС продолжает и развивает интеграционные начинания ЕврАзЭС. - Суд ЕАЭС, используя процессуальные механизмы создает обязательные для участников экономического оборота правила поведения, формируя право союза. Суд ЕАЭС создает собственную правовую систему, призванную регулировать отношения по его внутреннему функционированию. В частности, создаются внутреннее право организации (регламент суда), а также международно-правовые инструменты (соглашение о пребывании Суда на территории Республики Беларусь). - Судьи Суда ЕАЭС в значительной степени зависят от Высшего евразийского экономического совета и от государств-участников. Факт назначения на должность решением Высшего евразийского экономического совета по представлению государств-членов бесспорно повышает статус судей Суда Союза, однако также показывает, что правительства намерены контролировать весь процесс назначения судей. Принятие решения по этому поводу консенсусом означает, что состав Суда устанавливается по всеобщему согласию государств. Однако на национальном уровне процесс выбора кандидатов на должность судьи Суда не урегулирован. - Анализ норм Статута Суда позволяет выделить два ключевых критерия, имеющих значение для решения вопроса об отнесении спора к компетенции Суда. Основным (обязательным) критерием при определении компетенции Суда является то, что оспариваемое решение или действие (бездействие) Евразийской экономической Комиссии (далее – ЕЭК) непосредственно затрагивает права и законные интересы хозяйствующего субъекта. В качестве дополнительного (факультативного) критерия следует рассматривать то, что такое решение или действие (бездействие) Комиссии повлекло нарушение прав и законных интересов хозяйствующего субъекта. Однако указанные критерии не раскрыты в учредительных документах ЕАЭС. - Важную группу полномочий Суда ЕАЭС составляют дела о разъяснении положений права Союза путем предоставления консультативных заключений, которые носят рекомендательный характер. Однако, осуществление Судом разъяснения, не лишает государства-члены права на совместное толкование ими международных договоров, порядок которого на данный момент не определен. Не понятен при этом правовой статус решения Суда ЕАЭС о толковании договора, с которым не согласились государства-участники. Статут четко закрепляет, что разъяснение Суда ЕАЭС носит исключительно рекомендательный характер и государства-участники сами определяют какие национальные органы уполномочены обращаться в Суд ЕАЭС за разъяснениями. - Статут Суда не предусматривает юрисдикции Суда по трудовым спорам служащих институтов Союза. Суд ЕАЭС может лишь давать «необязательные консультативные заключения по заявлениям сотрудников и должностных лиц органов Союза по вопросам трудовых отношений». Можно предположить, что все трудовые споры служащих ЕЭК выведены из-под юрисдикции каких-либо судов, что говорит об абсолютной судебной незащищенности сотрудников ЕЭК и других институтов Союза. - Решение Суда не может выходить за рамки указанных в заявлении вопросов, и самое главное, что решение Суда не может изменять и (или) отменять действующие нормы права Союза, нормы законодательства государств-членов и не может создавать новые нормы права. В связи с этим можно предположить, что составители текста Договора о ЕАЭС, сделали все возможное, чтобы Суд ЕАЭС не имел возможности для создания правовой системы обособленной от государств-участников, к тому же обязали Суд ежегодно представлять Высшему совету отчет о своей деятельности. - В ходе исследования поставлена под сомнение оперативность осуществления досудебного урегулирования спора, выступающего одним из главных преимуществ досудебных процедур, а также проблема исчерпания процедуры досудебного урегулирования спора и неопределенности перечня документов, подтверждающих ее завершение. Процедура досудебного урегулирования спора должна стать предельно четкой и регламентированной, так как только в этом случае она может стать действенным способом защиты прав и законных интересов хозяйствующих субъектов в рамках евразийского экономического объединения.

Conclusions drawn from the study: - The EAEU court is not bound by formal relations of succession with the EurAsEC Court. At the same time, the EAEU Court, undoubtedly, can be considered a successor of the EurAsEC Court - just as the EAEU continues and develops the integration initiatives of the Eurasian Economic Community. - The court of the EAEU, using procedural mechanisms, creates rules of conduct binding for participants of the economic turnover, forming the right of union. The EAEU Court creates its own legal system, designed to regulate relations for its internal functioning. In particular, the internal law of the organization (the rules of the court), as well as international legal instruments (agreement on the stay of the Court on the territory of the Republic of Belarus) are created. - Judges of the EAEU Court are largely dependent on the Supreme Eurasian Economic Council and on the participating States. The fact that the Supreme Eurasian Economic Council has been appointed by decision of the Supreme Eurasian Economic Council unquestionably increases the status of judges of the Court of the Union, but it also shows that governments intend to monitor the entire process of appointing judges. The adoption of a decision on this matter by consensus means that the composition of the Court is established by universal agreement of the states. However, at the national level, the process of selecting candidates for the position of a judge of the Court has not been resolved. - An analysis of the norms of the Statute of the Court allows us to distinguish two key criteria that are relevant for resolving the issue of referring the dispute to the competence of the Court. The main (mandatory) criterion in determining the competence of the Court is that the impugned decision or action (inaction) of the Eurasian Economic Commission (hereinafter - the ECE) directly affects the rights and legitimate interests of the economic entity. As an additional (optional) criterion, it should be considered that such decision or action (inaction) of the Commission resulted in violation of the rights and legitimate interests of the economic entity. However, these criteria are not disclosed in the constituent documents of the EAEU. - An important group of powers of the EAEU Court are cases on clarifying the provisions of the law of the Union by providing advisory opinions, which are recommendatory in nature. However, the implementation of the clarification by the Court does not deprive the Member States of the right to jointly interpret international treaties, the order of which has not been determined at the moment. It is not clear at the same time the legal status of the decision of the Court of the EAEU on the interpretation of the treaty, which the participating States did not agree. The Statute clearly states that the explanation of the EAEU Court is purely recommendatory and the participating States themselves determine which national authorities are authorized to apply to the EEA Court for explanations. - The Statute of the Court does not provide for the jurisdiction of the Court on labor disputes of employees of the institutions of the Union. The EAEU court can only give "non-binding advisory opinions on applications of employees and officials of the Union's bodies for labor relations". It can be assumed that all labor disputes of ECE employees have been withdrawn from the jurisdiction of any courts, which indicates the absolute judicial insecurity of the staff of the ECE and other Union institutions. - The decision of the Court can not go beyond the questions indicated in the application, and most importantly, that the decision of the Court can not change and (or) revoke the current norms of the law of the Union, the norms of the legislation of the Member States and can not create new rules of law. In this regard, it can be assumed that the drafters of the text of the Treaty on the EEMP have done their utmost to ensure that the EEA Court does not have the opportunity to create a legal system separate from the participating states, moreover, the Court is required to report annually to the Supreme Council on its activities. - The study questioned the speed of the pre-trial settlement of the dispute, which is one of the main advantages of pre-trial procedures, as well as the problem of exhaustion of the procedure for pre-trial settlement of the dispute and the uncertainty of the list of documents confirming its completion. The procedure for pre-trial settlement of a dispute should be extremely clear and regulated, since only in this case it can become an effective way to protect the rights and legitimate interests of economic entities within the Eurasian economic association.
