Abstract

Тема выпускной квалификационной работы «Принцип гласности при подготовке и проведении выборов и его защита Конституционным Судом Российской Федерации». Целью выпускной квалификационной работы является выявление конфликта принципа гласности с другими принципами, которые имеют место в избирательном процессе. Поставленная цель исследования определила необходимость решения следующих задач: 1. обратиться к таким понятиям как «открытость», «транспарентность» и решить, как они соотносятся с понятием «гласности»; 2. дать определение понятию «гласность», установить его правовое содержание; 3. выявить соотношение принципа гласности с иными принципами в избирательном процессе в случаях их конфликта. Объект исследования – правовые отношения, возникающие в связи с действием принципа гласности при подготовке и проведении выборов. Предмет исследования — нормы законодательства, закрепляющие принцип гласности при подготовке и проведении выборов, а также правовые позиции Конституционного Суда РФ и материалы правоприменительной практики. Работа состоит из введения, основной части, заключения, а также включает в себя список использованных источников. Во введении обосновывается выбор темы выпускной квалификационной работы, ее актуальность, определяются цели и задачи исследования. Основная часть работы состоит из двух глав: первая глава включает в себя три параграфа, посвященных исследованию понятия, правового содержания принципа гласности, его компонентов, а также соотношения с иными понятиями; вторая глава включает в себя три параграфа, посвященных изучению соотношения принципа гласности с принципами самостоятельности и независимости деятельности избирательной комиссии, защиты персональных данных в избирательном процессе и общественного контроля за проведением выборов. В заключении сделаны выводы по проведенному исследованию: дается определение понятию «гласность при подготовке и проведении выборов», приведены основные компоненты, включаемые в данное понятие, а также сделаны выводы о соотношении принципа гласности с другими принципами в избирательном процессе. Работа выполнена на 70 страницах с использованием 88 источников литературы.

The goal of the final qualification work is to identify the conflict of the principle of transparency with other principles that take place in the electoral process. The goal of the study identified the need to solve the following problems: 1. address such concepts as "openness", "transparency" and decide how they relate to the concept of "glasnost"; 2. to define the concept of "glasnost", to establish its legal content; 3. To reveal the correlation of the principle of transparency with other principles in the electoral process in cases of their conflict. The object of the research is the legal relations arising in connection with the operation of the principle of transparency in the preparation and conduct of elections. The subject of the study is the norms of legislation that establish the principle of transparency in the preparation and conduct of elections, as well as the legal positions of the Constitutional Court of the Russian Federation and materials of law enforcement practice. The work consists of the introduction, the main part, the conclusion, and also includes a list of sources used. In the introduction, the choice of the theme of the final qualifying work, its relevance, and the goals and objectives of the study are justified. The main part of the work consists of two chapters: the first chapter includes three sections devoted to the study of the concept, the legal content of the principle of glasnost, its components, and also the relationship with other concepts; The second chapter includes three paragraphs on the correlation of the principle of transparency with the principles of independence and independence of the activities of the election commission, the protection of personal data in the electoral process and public control over the conduct of elections. In conclusion, conclusions on the study were made: the definition of "publicity in the preparation and conduct of elections" is given, the main components included in this concept are given, and conclusions are drawn about the correlation of the principle of glasnost with other principles in the electoral process. The work was completed on 70 pages using 88 sources of literature.
