The problem of human rights observance in US-China relations

Abstract

Проблема соблюдения прав человека – это один из вопросов, вызывающих серьёзные разногласия в отношениях США и Китая. Целью работы является выявление сущности американо-китайских противоречий по правозащитной проблематике на современном этапе через анализ подходов двух стран к обеспечению прав человека. Исследование демонстрирует, что видение Соединёнными Штатами и Китаем рассматриваемой проблемы серьёзно отличается: в то время как Вашингтон придерживается универсального подхода к пониманию прав человека и проводит политику продвижения демократических ценностей за рубежом, Пекин настаивает на альтернативном понимании термина и продвигает дискурс о государственном суверенитете в правозащитной области. Внешняя политика США направлена на принуждение китайских властей признать наличие проблем с обеспечением прав и свобод граждан на территории КНР через использование таких инструментов, как дипломатическое взаимодействие на высшем уровне, цифровая дипломатия, санкции, публичное порицание, мониторинг динамики ситуации внутри Китая, финансирование правозащитных программ в КНР, создание коалиции дружественных стран для совместной защиты демократических ценностей за рубежом. Китайская политика в данной области является оборонительной, так как она направлена на защиту от американских обвинений в несоблюдении норм международного права. Для реализации данного курса и продвижения дискурса о праве самостоятельно определять содержание понятия «права человека», КНР активно выступает на международных площадках, сотрудничает с ООН, публикует отчёты о прогрессе в области соблюдения правозащитных норм, осуществляет мониторинг ситуации с обеспечением данных положений в самих США.

The problem of human rights observance is one of the issues that cause serious disagreements in relations between the United States and China. The purpose of the study is to reveal the essence of the American-Chinese contradictions on human rights issues at the current stage through an analysis of the approaches of the two countries to ensuring human rights. The study demonstrates that the vision of the United States and China on the issue is seriously different: while Washington adheres to a universal approach to understanding human rights and pursues a policy of promoting democratic values abroad, Beijing insists on an alternative understanding of the term and promotes a discourse on state sovereignty in the human rights field. The US foreign policy is aimed at forcing the Chinese authorities to recognize the existence of problems with ensuring the rights and freedoms of citizens in the PRC. To realize this, the USA uses such tools as high-level diplomatic interaction, digital diplomacy, sanctions, public condemnations, monitoring the dynamics of the situation inside China, funding human rights programs in China, creating a coalition of friendly countries to protect democratic values abroad together. China’s policy in this area has defensive character, as it is aimed at protection against American accusations of failure to respect the international law. In order to implement this course and promote the discourse on the right to independently determine the concept of human rights, the PRC actively participates in international platforms, cooperates with the UN, publishes reports on progress in the field of observance human rights and monitors the situation with its provision in the United States itself.
