Specifics of legal regulation of sole trader's bankruptcy

Abstract

В данной работе рассматриваются отличительные особенности банкротства индивидуальных предпринимателей. Дана характеристика правовых последствий признания индивидуального предпринимателя банкротом, обращено внимание на особенности погашения обязательств по сравнению с юридическими лицами, изменения законодательства по исследуемому вопросу. На основе проведенного исследования автором предлагается произвести дополнение действующего законодательства нормами посвященным базовым принципам и целям банкротства физических лиц, формулируются основные проблемы и пути их решения. Цель настоящей работы заключается в исследовании теоретического и практического механизма регулирования банкротства индивидуального предпринимателя, а также в разработке конкретных правил и практических рекомендаций, которые устранили бы пробелы действующего законодательства в данной сфере деятельности.

This paper is focused on discusses the distinctive features of the bankruptcy of individual entrepreneurs. The legal consequences characteristic of recognizing an individual entrepreneur as a bankrupt is given, the author paid attention to the particularities of the repayment of obligations in comparison with legal entities, and changes in legislation. On the basis of the conducted research, the author proposes to supplement to the current legislation with rules dedicated to the basic principles and goals of the bankruptcy of individuals, the main problems and ways to solve them are formulated. The purpose of this work is to study the theoretical and practical mechanics for regulation the bankruptcy of an individual entrepreneur, as well as to develop specific rules and practical recommendations that would eliminate the gaps in the current legislation in this field.
