Legal issues of the protection of women’s rights in the UN system of monitoring bodies

Abstract

Данное исследование посвящено изучению вопросов, связанных с защитой прав женщин в системе конвенционных контрольных органов ООН. Цель исследования – изучение правового регулирования, функционирования и полномочий разветвленной системы уставных и договорных органов ООН, выявление и оценка правовых проблем международного контроля в этой сфере. Исследование выявило ряд серьезных правовых проблем в системе защиты прав женщин: недостаточный объем компетенции конвенционных органов и, прежде всего, Комитета ООН по ликвидации дискриминации в отношении женщин; сложность процедуры подачи, принятия и рассмотрения индивидуальных жалоб на нарушение государствами их международных обязательств; не четкость нормативного статуса принимаемых контрольными органами ООН актов и документов; отсутствие санкций и мер ответственности за нарушения государствами своих обязательств. Высказано мнение о возможных путях решения вышеуказанных проблем.

This study focuses on issues related to protection of women’s rights in the system of the UN treaty monitoring bodies. The aim of this study is to examine legal regulation, functioning and powers of ramified system of the UN Charter- and treaty-based bodies, to identify and assess legal issues of international control in this sphere. This study identified a number of serious legal issues in the system for the protection of women’s rights: lack of competence of the treaty bodies and above all, the UN Committee on the Elimination of Discrimination against Women; complexity of the procedure for filing, admission and examination of individual complaints regarding violations by states of their international obligations; ambiguity of normative status of the acts and documents adopted by the UN monitoring bodies; lack of sanctions and liability for violation by states of their obligations. The view was expressed on possible solutions of the above-mentioned issues.
