Abstract

В процессе исследования стояла задача ознакомиться с проблемами залогового права в России; вычленить наиболее обсуждаемые из них, в частности подробно рассмотреть проблему конкуренции интересов залоговых и незалоговых кредиторов; Одной из задач исследования было изучение судебной практики по толкованию статьи 78 Закона "Об исполнительном производстве".

-The task within this research was to learn the legal problems of the pledge in Russia, also identify those most discussable ones. Another task was to scrutinize the problem of competition between secured and unsecured debts. - One of the research's task was to study the jurisprudence practice and the interpretation of 78 Article of the Law about Enforcement Proceedings.
