Abstract

Исследование направлено на рассмотрение факта расширения компетенции международного публичного арбитража. Работа демонстрирует историческое становление и структуру Постоянной Палаты Третейского Суда, как первого институционного образование разрешения международных споров и классификацию Постоянной Палаты Третейского Суда. Исследуется проблема неэффективности Постоянной Палаты Третейского Суда и расширение компетенции через решения органа палаты. Также исследование демонстрирует юридическую аргументацию принятых решений и практический результат, расширенной компетенции. Объектом исследования является международный публичный арбитраж. Предметом исследования выступает правовые особенности международного межгосударственного арбитража; правовые особенности международного коммерческого арбитража; правовая основа расширения компетенции институционных арбитражей; правовой статус новых регламентов и правовой механизм аргументации и признания расширения компетенции Постоянной Палаты Третейского Суда. Выпускная квалификационная работа состоит из введения, трех глав, выводов по написанным главам и итогового заключения.

The research is aimed at examining the fact of the expansion of the competence of international public arbitration. The work demonstrates the historical formation and structure of the Permanent Court of Arbitration as the first institutional form of international dispute resolution and the classification of the Permanent Court of Arbitration. The problem of ineffectiveness of the Permanent Court of Arbitration and the expansion of competence through the decisions of the main organ of the Court is explored. Also, the study demonstrates the legal reasoning of the decisions taken by the main organ and the practical result of the expanded competence. The object of the study is the international public arbitration. The legal peculiarities of international interstate arbitration; the legal peculiarities of international commercial arbitration; the legal basis for the extension of institutional arbitration competence; the legal status of new regulations and the legal mechanism of argumentation and recognition of the extended competence of the Permanent Court of Arbitration are the subjects of research. The work consists of the introduction, three chapters and the final conclusion.
