Social commitments of developers in the construction of apartment buildings

Abstract

В исследовании автор анализ института социальных обязательств застройщика при строительстве многоквартирного дома. Интерес к представленной теме автор обосновывает тем, что бюджетными средствами решить проблему должной обеспеченности населения объектами социальной инфраструктуры не всегда удается, в связи с чем появляется необходимость привлекать застройщиков к решению данной задачи. Автором последовательно раскрывается теоретико-правовая основа института социальных обязательств застройщика. В частности, им дается анализ содержания и развития социальных обязательств застройщика в РФ, в результате которого выработаны принципы возложения и реализации социальных обязательств застройщика. Далее автором рассматриваются основания возникновения социальных обязательств застройщика. Практическая часть работы связана с рассмотрением проблемных аспектов реализации социальных обязательств застройщика. Основное внимание автор уделяет исследованию вопроса о неисполнении застройщиком социальных обязательств. По итогам исследования автором сделан вывод о том, что само по себе возложение обязанности на застройщика, который реализует при строительстве свой экономический интерес, допустимо и определенно позитивно сказывается на общем состоянии инфраструктуры в городе. В то же время, механизм возложения подобной обязанности должен быть прозрачным, конкретным и четко закрепленным в законе.

In the study, the author analyzes the institute of social obligations of the developer during the construction of an apartment building. The author justifies the interest in the presented topic by the fact that it is not always possible to solve the problem of proper provision of the population with social infrastructure facilities with budgetary funds, which makes it necessary to involve developers in solving this problem. The author consistently reveals the theoretical and legal basis of the institution of social obligations of the developer. In particular, they analyze the content and development of the developer's social obligations in the Russian Federation, as a result of which the principles of laying and implementing the developer's social obligations are developed. Further, the author examines the grounds for the emergence of social obligations of the developer. The practical part of the work is related to the consideration of problematic aspects of the implementation of the social obligations of the developer. The author pays special attention to the study of the issue of non-fulfillment by the developer of social obligations. According to the results of the study, the author concluded that in itself the assignment of responsibilities to the developer, who realizes his economic interest during construction, is permissible and definitely has a positive effect on the overall state of infrastructure in the city. At the same time, the mechanism for imposing such a duty should be transparent, specific and clearly enshrined in law.
