Protective zones of water supply and sewerage networks (centralized water supply and sewerage facilities) as a type of restriction of rights to land plots: problems of legal regulation and judicial practice

Abstract

Настоящая выпускная квалификационная работа посвящена теме правового регулирования охранных зон объектов централизованной системы водоснабжения и водоотведения. Автор ставит целью исследования определение проблем, связанных с правовым регулированием данных охранных зон и зон с особыми условиями территорий в целом, его особенностей, полноты и эффективности, определение возможных способов защиты прав владельцев объектов централизованной системы водоснабжения и водоотведения от нарушения охранных зон таких объектов и круга допустимых доказательств, способствующих наиболее эффективной защите. В работе предпринимается попытка определить отличительные признаки охранных зон объектов централизованной системы водоснабжения и водоотведения, установить, какое место данные охранные зоны должны занимать в системе ограничений прав на землю. Комплексный анализ законодательства и судебной практики подтверждает, что имеющееся в настоящее время правовое регулирование не решает вопрос, связанный с необходимостью обеспечения защиты от действий третьих лиц объектов централизованной системы водоснабжения и водоотведения при их эксплуатации организациями водопроводно-канализационного хозяйства. В связи с этим в работе также рассматриваются перспективы развития законодательства, регулирующего зоны с особыми условиями использования территорий и высказываются предложения по его совершенствованию.

This thesis is devoted to the topic of legal regulation of protective zones of objects of a centralized water supply and sewerage facilities. The author aims to study the problems associated with the legal regulation of these protective zones, and zones with special conditions of the territories as a whole, its features, completeness and effectiveness, the definition of possible ways to protect the rights of owners of objects of a centralized water supply and sewerage facilities from violation of this zones and the range of admissible evidence that contributes to the most effective protection of their rights. The work attempts to identify the distinctive features of the protective zones of objects of the centralized water supply and sewerage facilities, to establish what place these zones should occupy in the system of restrictions on land rights. A comprehensive analysis of legislation and judicial practice confirms that the current legal regulation does not resolve the issue related to the need to ensure protection from the actions of third parties of objects of the centralized water supply and sewerage facilities during their operation by water supply and sewerage organizations. In this regard, the work also considers the prospects for the development of legislation regulating zones with special conditions for the use of territories and makes proposals for its improvement.
