Information technologies in rule-making: theoretical and legal aspects

Abstract

В работе комплексно освещаются теоретические проблемы информационных технологий, возникающие при процессе их применения в нормотворческой деятельности. Автор обращает внимание на общую тенденцию применения нормотворчества, систематизацию и приходит к выводу о необходимости применения технологий искусственного интеллекта в этой сфере. Значительное внимание также уделяется технологиям искусственного интеллекта и большим данным в юридически значимых аспектах. Отталкиваясь от специфики технологичных норм, в том числе и в ретроспективе, регламентирующих сферу «сквозных» цифровых технологий автор уделяет внимание их взаимодействию с правом в целом, и нормотворческой деятельностью в частности. Благодаря этому приходит к выводу о том, что с одной стороны, существует оформленный набор, в котором формируется теоретическая аргументация, игнорирующая часть технического вопроса, а с другой стороны, большинство представителей технологических наук игнорируют теоретическую составляющую. Так, автор осуществляет попытку объединения указанных сторон. Несмотря на то, что по вопросам правовых проблем применения технологий искусственного интеллекта и больших данных в нормотворческой деятельности высказывается множество мнений, автор описывает теоретическую модель нормотворческого процесса, включающую применение таких технологий, но приходит к выводу о том, что необходимо проведение дальнейшего изучения данной сферы, что возможно, при дальнейшей реализации информационных технологий на практике.

The work comprehensively covers theoretical problems of information technology, arising in the process of their application in the rule-making activity. The author draws attention to the general trend of rulemaking application, systematization and comes to the conclusion about the need for artificial intelligence technologies in this area. Considerable attention is also paid to artificial intelligence technologies and big data in the legal aspects. Starting from the specifics of technological norms, including in a retrospective, regulating the sphere of "end-to-end" digital technology, the author pays attention to their interaction with the law in general, and rule-making in particular. Through this comes to the conclusion that on the one hand, there is a formalized set, which forms the theoretical argumentation that ignores part of the technical issue, and on the other hand, most representatives of the technological sciences ignore the theoretical component. Thus, the author makes an attempt to combine the said parties. Despite the fact that there are many opinions on the legal problems of the application of artificial intelligence and big data technologies in rulemaking, the author describes a theoretical model of the rulemaking process, which includes the application of such technologies, but concludes that further study of this area is necessary, which is possible, with further implementation of information technology in practice.
