Subsidiary liability of persons controlling the debtor in bankruptcy

Abstract

Выпускная квалификационная работа посвящена проблемам правового регулирования субсидиарной ответственности контролирующих должника лиц при банкротстве. В работе приводится понятие контролирующего должника лица, опровержимые презумпции наличия статуса контролирующего должника лица, проанализированы особенности ответственности контролирующих должника лиц, определена правовая природа субсидиарной ответственности контролирующих должника лиц при банкротстве, исследована история развития субсидиарной ответственности в российском праве, а также доктрина "снятия корпоративной вуали" в иностранных правопорядках.

The diploma is devoted to the problems of legal regulation of subsidiary liability of persons controlling the debtor in bankruptcy. The paper presents the concept of a controlling debtor person, refutable presumptions of the status of a controlling debtor person, analyzes the features of the responsibility of controlling debtor persons, determines the legal nature of subsidiary liability of controlling debtor persons in bankruptcy, examines the history of the development of subsidiary liability in Russian law, as well as the doctrine of "removing the corporate veil" in foreign legal systems.
