Special nature of regulating foreign policy at the supranational level: A case study of the European Union common foreign and security policy

Данная работа посвящена теме институционализации Общей внешней политики и политики безопасности Европейского союза (ОВПБ ЕС). Исследование обращается к теории интеграции с тем, чтобы объяснить институциональную динамику развития ОВПБ и определить особенности регулирования этой области. На основе предположений теории неофункционализма были выделены такие особенности развития ОВПБ, как зависимость от изначально выбранного пути, сравнительная изолированность от общего процесса интеграции и важная роль социальной интеграции акторов. Эти особенности нашли отражение в правовом измерении ОВПБ, где сохраняется специфика институционального оформления ОВПБ при растущей организационной близости к общему европейскому проекту и велика роль неформальных правил в регулировании деятельности акторов. При формально межгосударственной институциональной форме, отмечено также влияние в области ОВПБ наднациональных институтов. В целом, была сделана попытка сблизить международные отношения с изучением права и дать динамичное представление о регулировании внешней политики на наднациональном уровне на примере ОВПБ.

This paper explores the topic of institutionalization of the European Union Common Foreign and Security Policy (CFSP). The research is based on integration theory and aims at explaining the institutional dynamics of the CFSP in order to determine what is special about the way the policy is regulated. Building on the assumptions made by the neo-functionalist theory, following distinctive features of the CFSP development were identified: path dependence, relatively isolated position in the overall integration process and an important role of social integration. These features are reflected in the legal dimension of the CFSP, where the institutional form remains distinct despite growing proximity to the overall European project in organizational terms, and informal rules are of huge importance in regulating the activities of actors. While formally intergovernmental in its institutional form, the CFSP is nevertheless influenced by supranational institutions. On the whole, an attempt to bridge international relations and the study of law was made, as well as a dynamic account was given of how foreign policy is regulated at the supranational level as illustrated by the CFSP.
