Proprietary interest as an object of marine insurance

Abstract

В работе рассматриваются историко-правовые аспекты развития объекта морского страхования. Определяется понятие объекта морского страхования в системе элементов правоотношения. В ходе исследования анализируются российское и английское законодательство, касающееся страхового интереса и застрахованного имущества. В работе также рассматриваются теории и виды страхового интереса, раскрываются правовые проблемы, связанные с застрахованным имуществом и характером связи, которой достаточен для того, чтобы сформировать страховой интерес в морском страховании. Делаются выводы о необходимости внесения изменений в российское законодательство, касающееся страхования.

The study examines the historical and legal aspects of the development of the marine insurance object. It defines the term of the marine insurance object in the system of legal relationship elements. During the research, such aspects as the Russian and English legislation concerning insurable interest and insurable property are analyzed. The study also considers the concepts and types of insurable interest, reveals the legal issues related to the insurable property and the nature of the interest that is sufficient to form an insurable interest in marine insurance. The research has shown that the amendments to the Russian legislation that are related to the insurance, are to be done.
