Cooperation between Russia and Canada in protecting the cultural rights of indigenous peoples of the Arctic

Abstract

В работе рассматриваются особенности защиты культурных прав коренных народов Арктики на примере России и Канады. Представлена роль отдельных направлений культуры, а именно сфера образования коренных народов, их спортивная деятельность, а также кинематограф и народное художественное творчество. В исследовании сделан акцент на современном этапе: культурная деятельность коренных народов РФ преимущественно относится к периоду с 2014 года, когда вышел указ Президента об определении границ Арктической зоны Российской Федерации. Также культурная деятельность коренных жителей канадской Арктики представлена современным этапом. Был проведен анализ нормативно-правовой базы, относящейся к правовой защите культурных прав коренных народов Арктики в России и в Канаде. В ходе исследования были выявлены основные тенденции в установлении законодательного режима защиты культурных прав, рассмотрены особенности тематики культурных прав. В результате были определены области культурной деятельности, которым мало уделяется внимания в контексте рассмотрения проблематики коренных народов: дошкольное образование, спортивная деятельность, кинематограф и народное художественное творчество.

The paper examines the peculiarities of the protection of the cultural rights of the indigenous peoples of the Arctic on the example of Russia and Canada. The article presents the role of certain cultural areas, namely, the sphere of education of indigenous peoples, their sports activities, as well as cinema and folk art. The study focuses on the current stage: the cultural activities of the indigenous peoples of the Russian Federation mainly relate to the period from 2014, when the presidential decree on defining the borders of the Arctic zone of the Russian Federation was issued. Also, the cultural activities of the indigenous inhabitants of the Canadian Arctic are represented by the modern stage. The analysis of the legal framework related to the legal protection of the cultural rights of the indigenous peoples of the Arctic in Russia and in Canada was carried out. In the course of the study, the main trends in the establishment of a legislative regime for the protection of cultural rights were identified, and the features of the topic of cultural rights were considered. As a result, areas of cultural activity that receive little attention in the context of indigenous issues were identified: pre-school education, sports activities,cinema and folk art.
