Title security

Abstract

Право собственности широко используется в обороте в качестве альтернативы залогу для обеспечения исполнения обязательств. Титульное обеспечение является для кредитора более привлекательным в связи с отсутствием недостатков, имеющихся у залога. В выпускной квалификационной работе исследуется природа титульного обеспечения, его функции и причины использования, рассматриваются основные виды титульного обеспечения и подходы к его регулированию в зарубежных правопорядках. Также исследование предполагает проведение сравнения различных видов титульного обеспечения между собой и с правовым режимом залога. В работе делается вывод о возможности легализации титульных конструкций в российском законодательстве и их самостоятельном регулировании.

The ownership of the asset serving as property security is widely applied in commerce as an alternative to a pledge. The title security is more attractive for the creditor due to the absence of the disadvantages of the pledge. In the thesis the nature of title security, its functions and reasons for using it is investigated, the main types of title security and approaches to its regulation in foreign legal order are considered. The study also involves comparing different types of title security with each other and with the legal regime of pledge. The thesis concludes that it is possible to legalize title structures in Russian legislation and independently regulate them.
