Problems of judicial methodology in the legal doctrine of Hermann Kantorowicz

Abstract

В работе проанализировано правовое учение выдающегося немецкого юриста и историка права XIX-ХХ вв. – Германа Канторовича (1877-1940). Предметом исследования явилась актуализированная часть теоретико-правового наследия Канторовича – его манифест «Битва за юриспруденцию». Также исследована позиция Германа Канторовича к судебной методологии, в том числе требования, предъявляемые к «идеальному судье», который должен обладать не только юридическими знаниями, но и быть хорошо осведомленным о фактах общественной жизни и результатах исследований других социально-гуманитарных дисциплин.

In the work was analyzed legal doctrine on the judicial activities of an outstanding German lawyer and law historian of the XIX-XX centuries - Hermann Kantorowicz (1877-1940). The subject of the research is the updated part of the theoretical and legal heritage of Kantorowicz - his work «The Battle of Liberation for Legal Science». Also in the work was analyzed the position of Hermann Kantorowicz to the judicial methodology, including the requirements for the "judge's ideal", who should have not only legal knowledge, but also be knowledgeable about the facts of social life and research results of other social and humanitarian disciplines.
