The role of Russia in the Crimean case from the perspective of Kosovo scenario

Abstract

В данной работе исследуются относительно новые тенденции в области дихотомии права наций и народов на самоопределение и территориальной целостности государств. Цель исследования заключается в определении степени влияния событий, связанных с отделением Косово от Сербии на политику Российской Федерации в отношении Крыма. В работе устанавливаются линии преемственности сепаратистских конфликтов на примере двух означенных событий и выявляется прослеживаемая эволюция стратегий государств, сыгравших роль интервентов, в отношении Косово и Крыма соответственно. Установлено, что за невозможностью институционализации сценариев реализации права на самоопределение, имевших место в Крыму и в Косово в рамках международного права, выработка критериев «справедливой» гуманитарной интервенции остается в рамках легитимности. Исходя из полученных сведений, автор приходит к выводу, что в ходе реализации роли Российской Федерации в крымском вопросе, стратегии, используемые в ходе войны в Косово, были усвоены и доведены до инструментального совершенства. Тем не менее, критерии легитимности, выдвинутые конфликтом в Косово, удовлетворены не были, что выразилось в определенных международных последствиях. Материалы работы могут быть полезны исследователям в областях конфликтологии, стратегических изысканий, а также международного права в части, затрагивающей право народов на самоопределение.

In this work, new tendencies regarding the dichotomy of the right of peoples to self-determination and the territorial integrity of states are analyzed. The aim of the research is to determine the impact of events, surrounding Kosovo secession on the policy of the Russian Federation towards Crimea. The consistent patterns of separatist conflicts are established following the examples of the aforementioned events, and the traceable evolution of strategies of the states, acting as interventionists (in relation to Crimea and Kosovo, accordingly), is revealed. It has been established that, due to the impossibility of the scenarios of realization of the right to self-determination that took place in Kosovo and Crime ever being institutionalized in terms of international law, the elaboration of the criteria of a “just” humanitarian intervention rests within the sphere of legitimacy. Basing his assumptions upon the received data, the author comes to the conclusion that Russia’s carrying of its role in the Crimean crisis saw the apprehension and refinement of the strategies used in Kosovo. Nevertheless, the legitimacy criteria, put forward by the Kosovo conflict were not met, which resulted in particular international consequences. The findings of the work could be useful to the researchers in the fields of conflict and strategic studies, as well as those of international law addressing the right of peoples to self-determination.
