Constitutional and prejudicial court enquiries: similarities and differences (a case study of Russia, foreign countries, the Council of Europe and the European Union)

Abstract

САНКТ-ПЕТЕРБУРГСКИЙ ГОСУДАРСТВЕННЫЙ УНИВЕРСИТЕТ АННОТАЦИЯ магистерской диссертации студента магистратуры по программе "Конституционная юстиция" ФИО: Жаровских Евгений Дмитриевич Тема диссертации: "Конституционный и преюдициальный запросы судов: сходства и различия (по материалам России, зарубежных стран, Совета Европы и Европейского Союза)" Целью данного научного исследования является изучение правовой природы конституционного и преюдициальных запросов судов, а также выявление сходств и отличий указанных правовых феноменов. Для полноты научного исследования сравнительный анализ конституционного и преюдициального запросов производился на примере Российской Федерации, зарубежных государств, наднационального интеграционного объединения – Европейского союза, международного органа – Совета Европы. Для достижения вышеизложенной цели были поставлены следующие задачи: - изучение института преюдициального запроса на примере Европейского союза; - выработка понимания идеи консультативного запроса, закрепленного в Протоколе №16 Конвенции о защите прав человека и основных свобод; - анализ предпосылок введения в России института преюдициального запроса, перспективы его закрепления; - выявление правовой природы конституционного запроса судов, анализ особенностей его реализации на примере России и зарубежных стран. В работе выдвигается и обосновывается идея о необходимости введения в России института преюдициального запроса суда общей практики, который позволил бы судам выносить законные решения и тем самым обеспечил единообразие судебной практики. Актуальность и новизна исследования определяется, в первую очередь, изучением не до конца разрешенных научных проблем, связанных как конституционным судебным запросом, так и с преюдициальным судебным запросом. Применительно к конституционному запросу автором предприняты попытки объяснить критикам обоснованность возложения на суд обязанности обращения с конституционным запросом в Конституционный Суд РФ. Что касается преюдициального запроса, автор демонстрирует ошибочность понимания принципа «jura novit curia» (суд знает право), обосновывает введение института преюдициального запроса идеей оказания правовой помощи судам для правильного разрешения спора. В завершающей части работы сделаны выводы о сходстве и различиях рассматриваемых институтов.

For completeness of scientific research the comparative analysis of constitutional and pre-judicial inquiries was made on an example of the Russian Federation, foreign States, supranational integration Association – the European Union, international body – Council of Europe. In order to achieve the above objective, the following tasks were set:: - study of the institution of pre-trial inquiry on the example of the European Union; - developing an understanding of the idea of a consultative request contained in Protocol No. 16 of the Convention for the protection of human rights and fundamental freedoms; - the analysis of prerequisites of introduction in Russia of Institute of the preliminary inquiry, prospects of its fixing; - identification of the legal nature of the constitutional request of courts, analysis of the features of its implementation on the example of Russia and foreign countries. The paper proposes and substantiates the idea of the need to introduce in Russia the Institute of the pre-judicial inquiry of the court of General practice, which would allow courts to make lawful decisions and thereby ensure the uniformity of judicial practice. The relevance and novelty of the research is determined, first of all, by the study of not fully resolved scientific problems related to both constitutional judicial inquiry and pre-judicial inquiry. With regard to the constitutional request, the author attempts to explain the critics of the validity of the assumption by the court of the duty of treatment of a constitutional question to the constitutional Court of the Russian Federation. As for the pre-trial request, the author demonstrates the erroneous understanding of the principle "jura novit curia" (the court knows the law), substantiates the introduction of the institution of the pre-trial request by the idea of providing legal assistance to the courts for the correct resolution of the dispute. In the final part of the work conclusions about the similarity and difference of the institutions under consideration.
