Status of a foreign specialist in the Russian sports regulations in the unified legal space of the WTO and the EAEU

Abstract

Целью данной работы является исследование возможности применения норм ВТО и ЕАЭС к регулированию статуса иностранного специалиста российскими спортивными регламентами. В соответствии с целью в работе поставлены следующие задачи: - определить понятие и способы формирования единого правового пространства; - рассмотреть механизмы регулирования перемещения физических лиц в рамках ВТО и ЕАЭС; - раскрыть понятие «иностранный специалист»; - проанализировать источники регулирования трудовых отношений иностранных специалистов в сфере спорта; - выявить правовую природу российских спортивных регламентов и их значение в определении статуса иностранных специалистов; - рассмотреть ограничения на профессиональную деятельность иностранного специалиста в сфере спорта в контексте норм ВТО и ЕАЭС. Основные выводы исследования: 1) нормы ВТО не применимы к вопросу регулирования статуса иностранного специалиста российскими спортивными регламентами как в связи с недостаточной урегулированностью вопроса о перемещении физических лиц в рамках ВТО, так и в связи с особенностями «горизонтальных обязательств» России; 2) нормы ЕАЭС распространяются на спортивную сферу, в том числе и на вопросы перемещения спортсменов и статуса спортсмена в стране, гражданства которой он не имеет; 3) однако последний вывод не означает автоматической и очевидной необходимости уравнивания в правах отечественных и иностранных спортсменов. Для решения данного вопроса предлагается внести существенные изменения в документы спортивных организаций, осуществляющих совместное с государством регулирование трудовых отношений в сфере спорта.

The purpose of this article is to investigate the possibility of applying WTO and EAEU rules to the regulation of the status of a foreign specialist by Russian sports regulations. In accordance with the purpose of this article the following tasks are set: - to define the concept and methods of forming a single legal space; - consider mechanisms for regulating the movement of individuals within the WTO and the EAEU; - to expose a concept "foreign specialist"; - to analyze sources of regulation of labor relations of foreign experts in the area of sports; - to reveal the legal nature of Russian sports regulations and their importance in determining the status of foreign specialists; - consider limits on the professional activity of a foreign sports specialist in the context of WTO and EAEU rules. Basic conclusions of this article: 1) the WTO rules not applicable to the regulation of the status of a foreign specialist by russian sports regulations both in connection with the insufficient settlement of the question of movement of individuals within the WTO, and in connection with the specifics of Russia's "horizontal obligations"; 2) the rules of the EAEU apply to the sports, including on question of the movement of athletes and the status of an athlete in a country of which he does not have citizenship; 3) the last conclusion does not mean an automatic and obvious need to equalize the rights of domestic and foreign athletes. For the decision of this question it is suggested to bring in substantial changes in the documents of sport organizations carrying out the joint with the state adjusting of labour relations in sport.
