Specific features of translating legal terminology: A case study of the translation of German commentary of the Constitution of the Russian Federation

Abstract

Настоящая работа посвящена выявлению и анализу особенностей перевода юридической терминологии. Материалом работы послужил текст комментария к российской Конституции 1993 года «Handbuch der russischen Verfassung», составленного немецкоязычными учеными-правоведами, а именно австрийскими и немецкими, а также текст перевода данного комментария на русский язык. В работе освещаются подходы к определению понятия «юридический документ», обозначаются особенности юридического комментария как отдельного типа текста, проводится анализ юридического дискурса и его параметров, приводятся подходы к толкованию понятия «термин», а также классификация терминов и их основные свойства, раскрываются особенности перевода юридических терминов и текстов с немецкого языка на русский. Практический анализ материала показал, что юридическая терминосфера русского и немецкого языка близки к другу, однако существует ряд различий, обусловленных различиями в правовых системах России и Германии. Кроме того, было установлено влияние морфологической структуры термина на сложность перевода, а также выявлена зависимость степени переводимости юридического текста от экстралингвистических параметров. Общий объем работы составляет 87 страниц.

The paper is dedicated to research and analysis of typical features of translation of legal terminology. The thesis is a case study of the commentary to the Russian Constitution of 1993 «Handbuch der russischen Verfassung» written by German and Austrian lawyers and of its translation into Russian. The paper investigates possible approaches to the concept of legal document and to the concept of term, names typical features of legal commentary as a type of text, contents analysis of legal discourse and its characteristics. It also provides classification of legal terms, their typical features and possible problems and strategies of translating them from German into Russian. In accordance with the results of the practical analysis, German and Russian legal term systems have much in common, but there are also some differences reasoned by differences in the legal systems of Germany and Russia. There is also a connection between the morphological structure of a term and the difficulty of its translation and between extralinguistic conditions and the possibility of translation of a legal text. The volume of the thesis is 87 pp.
