САНКТ-ПЕТЕРБУРГСКИЙ ГОСУДАРСТВЕННЫЙ УНИВЕРСИТЕТ АННОТАЦИЯ Выпускной квалификационной работы студентки 2 курса магистратуры по программе «Гражданское право, семейное право, международное частное право» Яковлевой Анастасии Александровны Тема выпускной квалификационной работы: «Принудительные сервитуты» Цели и задачи исследования: 1. Вывести определение понятия «принудительные сервитуты», проанализировать правовое регулирование принудительных сервитутов в Российской Федерации и сравнить его с правовым регулированием указанного института в зарубежных странах. 2. Рассмотреть процедуры установления сервитута в судебном и административном порядках с целью выявления основных условий, применяемых к таким порядкам установления сервитута. 3. Проанализировать подходы к возмездности сервитута для определения порядка установления и осуществления платы за сервитут. 4. Выявить критерии определения размера платы за сервитут. 5. Изучить основания и действия по прекращению и изменению сервитутов, поскольку данный раздел практически не затрагивается в работах по данному институту. Выводы, сделанные по результатам исследования: Данная область права является весьма перспективной, поскольку судебные споры по поводу сервитутов не прекращаются. Вместе с тем, российское законодательство требует значительной доработки и детализации, как в рамках регулирования сервитутов в целом, так и принудительных сервитутов в частности. Предлагается следующее определение: Принудительный сервитут – это право ограниченного пользования чужой вещью, установленное: 1. в судебном порядке, по иску лица, требующего установить сервитут, при недостижении соглашения или наличии разногласий относительно условий соглашения или 2. в административном порядке, по заявлению заинтересованного лица, собственника (или будущего собственника), подразумевающее возмездный характер, компенсацию для собственника обремененной вещи. В Российской Федерации отсутствует отдельное регулирование принудительных сервитутов, установленных судебным решением. Так и в целом, анализ существующих в ГК РФ норм о сервитутах свидетельствует об их недостаточности и нераскрытости. Правовое регулирование административных сервитутов существенно шире, содержится в специальных законах. Принудительные сервитуты также существуют и в зарубежных странах. Принудительные сервитуты в основном характерны для стран постсоветского пространства, Италии, Испании, Аргентина. Есть ряд стран, в которых принудительные сервитуты воспринимаются как крайнее исключение из общего правила о добровольных сервитутах. Одновременно с этим иногда конструкцию, схожую с принудительным сервитутом и вовсе относят к иной категории, нежели к сервитуту (Германия, Нидерланды, Швейцария). Условиями установления сервитута в судебном порядке являются: наличие спора (отказ в заключении соглашения, разногласия по поводу условий соглашения), наличие объективной необходимости установления сервитута, соблюдение баланса интересов при установлении сервитута. Процедура установления административного сервитута и судебного отличаются, хотя бы тем, что в первом случае решение выносит орган исполнительной власти субъекта Российской Федерации, а во втором – суд. Административный сервитут не подлежит государственной регистрации. Плата за сервитут – неотъемлемое условие принудительных сервитутов, так как иначе права собственника обремененной вещи нарушаются, ограничивают без компенсации. Плата за сервитут может выражаться в виде единовременной выплаты или периодических платежей. Предлагается ввести правило, согласно которому, если сервитут срочный, то допустима единовременная выплата, если же бессрочный – периодические платежи. Законодательство многих стран постсоветского пространства придерживается подхода о существовании единовременной выплаты и периодических платежей, однако есть и такие, где плата либо предусмотрена только в качестве периодических платежей, либо где плата предусмотрена только как единовременная выплата. На сегодняшний день в законодательстве плата за сервитут определяется как соразмерная, такое же определение есть в некоторых зарубежных странах (Франция). Отсутствует закрепление критериев определения размера платы за сервитут, установленный в судебном порядке, однако решение предлагается в судебной практике и литературе (плата как убытки, плата как арендные платежи). При определении платы за сервитут также следует учитывать срок сервитута, площадь его установления, интенсивность и характер использования участка, убытки. В отношении административного сервитута есть определенные критерии определения размера платы за сервитут, которые различаются категорией земельного участка (публичная или частная собственность). ГК РФ не содержит широкого правового регулирования оснований прекращения и изменения сервитутов. Проект ГК немного расширяет данную категорию, хотя все еще нуждается в детализации, это вызвано наличием пробелов права. Следует установить отдельно регулирование прекращения принудительных сервитутов, установленных судебным решением. Правовое регулирование административного сервитута в этой области шире – в специальных законах устанавливаются различные основания и порядки прекращения сервитута.

The findings of the study: This area of ​​law is very promising, as litigation over easements does not stop. At the same time, Russian legislation requires considerable refinement and detailing, both within the regulation of easements in general, and forced easememnts in particular. The following definition is proposed: Forced easement is the right of limited use of another's thing, established: 1. in court, at the suit of a person requiring the establishment of an easement, if the agreement is not reached or if there are disagreements about the terms of the agreement or 2. administratively, at the request of the person concerned , The owner (or future owner), implying a compensated nature, compensation for the owner of the encumbered thing. In the Russian Federation there is no separate regulation of forced easements established by a judicial decision. So, in general, the analysis of the existing norms in the Civil Code of the Russian Federation on easements indicates their insufficiency and non-disclosure. Legal regulation of administrative servitudes is much broader, contained in special laws. Forced easements also exist in foreign countries. Forced easements are mainly found in post-Soviet countries, Italy, Spain, Argentina. There are a number of countries in which this easements are perceived as the extreme exception to the general rule on voluntary easements. At the same time, sometimes there are constructions similar to forced easement is considered to belong to a different category rather than easement (Germany, the Netherlands, Switzerland). The conditions for the establishment of an easement in court are: the existence of a dispute (refusal to enter into an agreement, disagreement over the terms of the agreement), the existence of an objective need to establish an easement, the balance of interests in the establishment of an easement. The procedure for establishing an administrative servitude and judicial easement are different, at least in the fact that in the first case the decision is made by the executive body of the subject of the Russian Federation, and in the second - by the court. Administrative easement is not subject to state registration. The payment for easement is an integral condition of compulsory servitudes, since otherwise the rights of the owner of the encumbered thing are violated, limited without compensation. The fee for easement can be expressed in the form of a lump sum or periodic payments. It is proposed to introduce a rule according to which if a servitude is urgent, then a lump sum payment is allowed, if it is termless then periodic payments. Legislation of many countries of the post-Soviet space adheres to the approach of the existence of a lump sum and periodic payments, but there are also those where the fee is either provided only as periodic payments or where the fee is only provided as a lump sum payment. Today the payment for an easement is defined as commensurate, the same definition is in some foreign countries (France). There is no fixation of the criteria for determining the amount of payment for easement, established in court, but the decision is proposed in judicial practice and literature (payment as losses, payment as rent payments). When determining the fee for easement, one should also take into account the term of easement, the area of ​​its establishment, the intensity and nature of the use of the site, and losses. To administrative easement, there are certain criteria for determining the amount of payment for easement, which is different in the category of the land plot (public or private property). The Civil Code of the Russian Federation does not contain a broad legal regulation of the grounds for termination and change of easements. The draft of Civil Code slightly expands this category, although it still needs to be detailed, this is due to the presence of legal gaps. It is necessary to establish separately the regulation of termination of compulsory servitudes established by a judicial decision. Legal regulation of administrative servitude in this area is broader - in special laws different grounds and procedures for termination of servitude are established.
