International Copyright Protection of in Telecasting

Abstract

The purpose of this research is to identify the system of international copyright protection in telecasting that has developed over the last 30 years, therefore, the objectives of the study are to analyze the current state of international copyright protection in telecasting, the relationship between international copyright protection for broadcast and the Internet, revealing the content of the right to communication to the public. The author used a complex of general scientifi c and philosophical methods, including logical, comparative-legal, formal-legal, systemic-structural, problematic-theoretical and methods of analysis and synthesis, generalization methods and descriptions, as well as comparisons. Article 11.bis of the Berne Convention plays a key role in the international protection of copyright in telecasting. After the consideration of the international treaties aimed to copyright protection in telecasting should be recognized that a number of them is in relation with the Berne Convention. However, it is not possible to speak about a well-established system of international treaties aimed at copyright protection in telecasting because systemic connections are not always clearly seen. The basis for international copyright protection in radio broadcasting, telecasting and electronic telecommunications is the same, the right of communication to the public provided for in article 11bis (1) “i” of the Berne Convention, subject to the provisions of article 8 of the WIPO Copyright Treaty. It can be argued that a subinstitute, namely, international legal protection of intellectual property when using telecommunications, will be created in the framework of the comprehensive institute which will be the international legal protection of intellectual property.
