Deformalisation of criminal proceedings in the context of digital technologies development

Abstract

Автором проводится комплексное исследование деформализации уголовного судопроизводства через призму тенденций развития цифровых технологий. Актуальность исследования последовательно обосновывается фрагментарностью текущего регулирования и отсутствием концептуального подхода ко внедрению современного инструментария в уголовное судопроизводство. Особое внимание в методологии в рамках исследования уделено сравнительно-правовому методу, так как автор анализирует законодательство и практику зарубежных стран на предмет возможной имплементации в законодательство Российской Федерации. В первой части автор исследует общие теоретико-правовые положения о деформализации уголовного судопроизводства в контексте цифровых технологий. Вторая часть исследования посвящена особенностям деформализации досудебного производства и судебного разбирательства по уголовным делам в условиях цифровой трансформации. В рамках исследования предложен авторский подход к определению понятия «деформализация уголовного судопроизводства», определены основные принципы деформализации уголовного судопроизводства в контексте развития цифровых технологий, разработаны концептуальные элементы деформализации, приведено авторское обоснование реализации концепции, предложен проект онлайн-формы заявления о совершении преступления в виде анкеты, адаптированной под нужды заявителя, разработана модель экосистемы государственных информационных и автоматизированных систем в сфере уголовного судопроизводства с ядром в виде электронного уголовного дела с делением на модули. Автором сделан вывод о том, что применение цифровых технологий требует соблюдения баланса, поскольку является не самоцелью, а средством достижения цели. Разработанная модель деформализации уголовного судопроизводства направлена на одновременное объединение уже существующих и новых научных разработок для оптимизации и объективизации уголовно-процессуальной деятельности без ущерба фундаментальным требованиям уголовно-процессуального закона. Выводы автора подтверждаются результатами проведенного анкетирования, материалами следственной и судебной практики, профессиональным опытом автора, полученным в ходе осуществления адвокатской деятельности.

The author conducts a comprehensive study of the deformation of criminal proceedings through the prism of trends in the development of digital technologies. The relevance of the study is consistently justified by the fragmentation of current regulation and the lack of a conceptual approach to the introduction of modern tools in criminal proceedings. Special attention in the methodology of the study is paid to the comparative legal method, as the author analyzes the legislation and practice of foreign countries for possible implementation into the legislation of the Russian Federation. In the first part, the author explores the general theoretical and legal provisions on the deformation of criminal proceedings in the context of digital technologies. The second part of the study is devoted to the peculiarities of the deformation of pre-trial proceedings and criminal proceedings in the context of digital transformation. Within the framework of the study, the author's approach to the definition of the concept of "deformalization of criminal proceedings" is proposed, the basic principles of deformalization of criminal proceedings in the context of the development of digital technologies are defined, conceptual elements of deformalization are developed, the author's justification for the implementation of the concept is given, a draft online application form for the commission of a crime in the form of a questionnaire adapted to the needs of the applicant is proposed, a model of the ecosystem of state information and automated systems in the field of criminal justice with a core in the form of an electronic criminal case divided into modules has been developed. The author concludes that the use of digital technologies requires a balance, since it is not an end in itself, but a means to achieve the goal. The developed model of deformalization of criminal proceedings is aimed at simultaneously combining existing and new scientific developments to optimize and objectify criminal procedural activities without prejudice to the fundamental requirements of the criminal procedure law. The author's conclusions are confirmed by the results of a verified questionnaire, materials of investigative and judicial practice, and the author's professional experience gained in the course of practicing law.
