Government regulation of cryptocurrencies and digital financial assets: comparative study of international practices

Abstract

Проблема государственного регулирования криптовалют и финансовых цифровых активов является сверхактуальной, и в настоящее время значится важным объектом для создания правовых инструментов регулирования данной среды государством. В рамках данной работы рассматриваются теоретические аспекты регулирования криптовалют, а именно произведен подробный разбор понятия криптовалюты и цифровых финансовых активов, их особенности и признаки, история становления криптовалют как полноценного сектора в мировой экономике, а также проведен институциональный анализ регулирования криптовалют разными странами мира, начиная от зарождения данной сферы до настоящего времени. В практической части произведен сравнительный анализ механизмов регулирования криптовалют на предмет их сходств и различий в подходах к определению, правовому регулированию, а также выявлены сходства и различия в регулировании с традиционными денежными инструментами. Помимо этого, также было доказано отсутствие прямой корреляции между подходом к регулированию криптовалютной среды между демократическими и авторитарными странами.

The problem of state regulation of cryptocurrencies and financial digital assets is extremely relevant, and is currently listed as an important object for creating legal instruments for regulating this environment by the state. Within the framework of this work, the theoretical aspects of the regulation of cryptocurrencies are considered, namely, a detailed analysis of the concept of cryptocurrencies and digital financial assets, their features and characteristics, the history of the formation of cryptocurrencies as a full-fledged sector in the global economy, and an institutional analysis of the regulation of cryptocurrencies by different countries of the world, ranging from origin of this area until the present. In the practical part, a comparative analysis of the mechanisms for regulating cryptocurrencies was made for their similarities and differences in approaches to definition, legal regulation, and similarities and differences in regulation with traditional monetary instruments were identified. In addition, it has also been proven that there is no direct correlation between the approach to regulating the crypto-currency environment between democratic and authoritarian countries.
