Regulating the issues of the conflict of laws on intellectual property in the European Union

Abstract

В настоящей работе будет произведен анализ правовой системы ЕС в области регулирования интеллектуальной собственности и ее взаимодействия с национальными правопорядками. Особое внимание будет уделено коллизионному регулированию интеллектуальной собственности. На основе данного исследования будут выявлены и проанализированы достоинства и недостатки коллизионного регулирования интеллектуальной собственности, выделены основные трудности, возникающие в процессе правоприменительной практики, предложены варианты предупреждения данных проблем при разработке правового регулирования интеллектуальной собственности в интеграционных объединениях. Результаты данного исследования могут быть использованы при разработке коллизионного регулирования интеллектуальной собственности в ЕАЭС. Это является актуальной темой, поскольку правовое регулирование исследуемой сферы в ЕАЭС находится на начальном этапе развития. Анализ правового опыта другого интеграционного объединения поможет минимизировать негативные последствия пробелов в правовом регулировании, оптимизировать процесс рассмотрения судебных споров, повысить предсказуемость процесса определения применимого права как для участников правоотношений, так и для регуляторов этих правоотношений.

This work will analyse the EU legal system for the regulation of intellectual property and its interaction with national legal order. Particular attention will be given to conflict-of-laws regulation of intellectual property. On the basis of this study the advantages and disadvantages of conflict-of-laws regulation of intellectual property will be identified and analyzed, the main difficulties arising in the process of enforcement, It offers options of prevention of these problems when developing the legal regulation of intellectual property in integration associations. The results of this study can be used in the development of conflict regulation of intellectual property in the EAEU. This is a topical topic, as the legal regulation of the studied sphere in the EAEU is at the initial stage of development. The analysis of the legal experience of another integration association will help to minimize the negative consequences of gaps in legal regulation, optimize the process of litigation, Increase the predictability of the process of determining the applicable law for both parties to a legal relationship and the regulators of that legal relationship.
