Criminal law provisions on the security of commercial confidentiality in the Russian Federation

Abstract

Настоящая дипломная работа посвящена рассмотрению проблематики регулирования коммерческой тайны и иной конфиденциальной информации в Российской Федерации. Настоящая работа включает в себя введение, три содержательных главы, заключение и список литературы. Каждая глава посвящена конкретному аспекту рассматриваемой темы. Так, в первой главе шла глубоком теоретическом уровне рассматриваются правовые основы регулирования коммерческой тайны в Российской Федерации. Во второй и третьей главах фокус внимания исследователя сосредоточен на рассмотрении вопросов, связанных с ответственностью за нарушение режима коммерческой тайны, в особенности уголовной ответственности. В качестве нормативной базы для написания настоящей работы используется действующая законодательная база, в том числе подзаконные акты, разъяснения высших слов, рассматриваются конкретные судебные прецеденты, а также анализируется действующая международно-правовая практика.

This thesis is devoted to the consideration of the problems of regulation of trade secrets and other confidential information in the Russian Federation. This work includes an introduction, three informative chapters, a conclusion and a list of references. Each chapter is devoted to a specific aspect of the topic under consideration. Thus, in the first chapter, the legal foundations of the regulation of trade secrets in the Russian Federation are considered at a deep theoretical level. In the second and third chapters, the focus of the researcher's attention is focused on the consideration of issues related to liability for violation of the trade secret regime, especially criminal liability. As a normative basis for writing this work, the current legislative framework is used, including by-laws, explanations of higher words, specific judicial precedents are considered, and the current international legal practice is analyzed.
