dc.description.abstract | Целью настоящей выпускной квалификационной работы является, во-первых, комплексный анализ последствий повышения уровня моря, во-вторых, анализ позиций и реакций государств, международных организаций, международных судебных органов на повышение уровня моря, в-третьих, выявление применимого права в контексте повышения уровня моря, в-четвертых, установления обязательств государств по предупреждению причинения ущерба экологическим среде, обязательств по защите климата, а также возможных форм ответственности государств в случаях причинениях трансграничного ущерба. Выводы, сделанные по результатам исследования: Государства не должны изменять существующие морские права, заложенные в Конвенции ООН по морскому праву 1982 г. в связи с повышением уровня моря. Государства могут «заморозить» существующие исходные линии и не обязаны их обновлять, в таком случае не возникнут новые территориальные споры и споры касающиеся к доступу к природным ресурсам, поскольку морские зоны останутся неизменными. Тема правовых последствие повышения уровня моря волнует все международное сообщество, в связи с чем государств аи международные организации устраивают конференции, подают запросы о Консультативных заключения в международные судебные органы. В качестве применимого права в контексте решения последствий, вызванных повышения уровня моря, необходимо рассматривать не только Конвенцию ООН по морскому праву 1982 г., но и весь климатический режим ООН. У государств есть обязательства по защите и сохранению морской среды, предупреждению причинения трансграничного вреда экологической системе. Указанные обязательства являются как нормами обычного международного права, так и содержаться в Конвенции ООН по морскому праву 1982 г., РКИК ООН и Парижском соглашении. Согласно Проекту Статей об ответственности государств и практике международных судебных органов, государства могут быть признаны виновными за причиненный трансграничный ущерб и должны выплачивать репарации. | ru_RU |
dc.description.abstract | The purpose of this graduate qualification work is, first, a comprehensive analysis of the consequences of sea level rise, second, analysis of the positions and reactions of states, international organizations, international judicial bodies to sea level rise, third, identification of applicable law in the context of sea level rise, fourth, establishment of the obligations of states to prevent environmental damage, climate protection obligations, as well as possible forms of state responsibility in cases of transgression Conclusions drawn from the study: States should not alter existing maritime rights inherent in the 1982 UN Convention on the Law of the Sea due to sea level rise. States can "freeze" existing baselines and are not required to update them, in which case no new territorial disputes or disputes over access to natural resources would arise, as maritime zones would remain unchanged. The topic of the legal consequences of sea level rise is of concern to the entire international community, so states and international organizations organize conferences, submit requests for Advisory Opinions to international judicial bodies. Not only the 1982 UN Convention on the Law of the Sea, but also the entire UN climate regime must be considered as the applicable law in the context of dealing with the consequences caused by sea level rise. States have obligations to protect and preserve the marine environment and to prevent transboundary harm to the ecological system. These obligations are both norms of customary international law and contained in the 1982 UN Convention on the Law of the Sea, the UNFCCC and the Paris Agreement.
