Legal aspects of the activities of the private healthcare system and interaction with the state in the framework of the global challenges of our time

Abstract

Право на здоровье принадлежит к группе неотъемлемых естественных прав и свобод человека, сопровождающих его жизнедеятельность. Принцип обеспечения баланса интересов граждан, общества и государства в области охраны здоровья граждан является одним из основных принципов государственной политики, поскольку призван соблюдать интересы каждого субъекта складывающихся общественных отношений в сфере здравоохранения. На основании данного принципа осуществляется широкий ряд взаимодействий, например государства и частной системы здравоохранения. Осуществление коммерческой деятельности в области частной системы здравоохранения с присущими ей нюансами и особенностями вызывает большой интерес, поскольку данная деятельность основывается на объемной нормативно-правовой базе, разнообразной правоприменительной практике и уникальном практическом, теоретическом опыте. Правовое сопровождение частной медицинской деятельности требует наличие определенного уровня навыков, обязывает к знанию зарубежной практики в отрасли здравоохранения, вызывает необходимость действовать под влиянием глобальных вызовов современности и вносить соответствующие изменения в деятельность. Применимость данного исследования для практической деятельности возможна ввиду выявленных проблем и предложенных изменений, основными из которых являются: введение индивидуализированного подхода при лицензировании медицинской деятельности, обход строгой стандартизации правовой базы, учет фактической деятельности медицинского бизнеса, повышение участия Верховного и Конституционного Суда в формировании правовых позиций по спорным вопросам, замена концессионного соглашения на соглашение, предусматривающее иной подход к переходу права собственности, льготное кредитование малого и среднего медицинского бизнеса и иные меры, влияющие на частную медицинскую деятельность.

The right to health belongs to the group of inalienable natural rights and freedoms of a person accompanying his life activity. The principle of ensuring a balance of interests of citizens, society and the state in the field of public health protection is one of the basic principles of state policy, since it is designed to respect the interests of each subject of the emerging public relations in the field of healthcare. Based on this principle, a wide range of interactions are carried out, for example, between the state and the private healthcare system. The implementation of commercial activities in the field of the private healthcare system with its inherent nuances and features is of great interest, since this activity is based on a voluminous regulatory framework, diverse law enforcement practice and unique practical, theoretical experience. Legal support of private medical activity requires a certain level of skills, requires knowledge of foreign practice in the healthcare industry, causes the need to act under the influence of global challenges of our time and make appropriate changes in activities. The applicability of this study for practical activity is possible due to the identified problems and proposed changes, the main of which are: the introduction of an individualized approach to licensing medical activities, circumvention of strict standardization of the legal framework, accounting for the actual activities of medical business, increasing the participation of the Supreme and Constitutional Courts in the formation of legal positions on controversial issues, replacing the concession agreement with an agreement providing for a different approach to the transfer of ownership, preferential lending to small and medium-sized medical businesses and other measures affecting private medical activity.
