Protecting the rights of private participants in shared construction by using the fund model

Abstract

Целью исследования является комплексное исследование вопросов, связанных с особенностями защиты прав граждан – участников долевого строительства с использованием модели фонда по российскому законодательству. Объектом исследования являются общественные отношения, определяющие особенности защиты прав граждан – участников долевого строительства. Структура работы содержит три главы. В первой главе рассматриваются теоретико-методологические основы механизма защиты прав дольщиков-участников долевого строительства по российскому законодательству; во второй главе представлен анализ особенностей деятельности Фонда защиты прав граждан – участников долевого строительства как специального способа защиты их прав; в третьей главе исследованы проблемы теории и практики реализации защиты прав граждан-участников долевого строительства. Определены основные направления совершенствования правового регулирования защиты прав граждан-участников долевого строительства.

The purpose of the study is a comprehensive study of issues related to the peculiarities of protecting the rights of citizens participating in shared–equity construction using the fund model under Russian law. The object of the study is social relations that determine the features of protecting the rights of citizens participating in shared–equity construction. The structure of the work contains three chapters. The first chapter discusses the theoretical and methodological foundations of the mechanism for protecting the rights of equity holders participating in shared-equity construction under Russian law; the second chapter presents an analysis of the features of the Fund for the Protection of the Rights of Citizens Participating in shared-equity Construction as a special way to protect their rights; the third chapter examines the problems of theory and practice of implementing the protection of the rights of citizens participating in shared–equity construction. The main directions of improving the legal regulation of the protection of the rights of citizens participating in shared-equity construction are determined.
