The evolution of the German migration policy from 1991 to 2019

Abstract

Цель работы – определить ключевые особенности эволюции миграционной политики ФРГ с 1991 по 2019 годы. Несмотря на большое количество направлений в исследовании миграционной политики как среди отечественных, так и зарубежных исследователей, в настоящее время не существует работ, посвященных непосредственно анализу всей эволюции миграционного законодательства ФРГ с учетом новейших событий. Поэтому источниковой базой данной работы являются непосредственно законодательные акты ФРГ, связанные с миграционной и интеграционной политикой; статистические ежегодники статистического ведомства Германии; предвыборные партийные программы тех партий, которые в результате выборов получали места в Бундестаге, а также СМИ. В рамках ВКР анализируются изменения в миграционном и интеграционном законодательстве ФРГ за последние три десятилетия, а также рассматриваются основные факторы, повлиявшие на этот процесс. В результате исследования автор делает вывод о том, что миграционная политика Германии в период 1991-2014 гг. справлялась с потоками прибывающих иммигрантов, но оказалась неготовой к миграционному кризису, начавшемуся в августе-сентябре 2015 года. Правительству Германии удалось стабилизировать ситуацию только к началу 2018 года. На основании проделанной работы были выделены шесть особенностей эволюции миграционной политики: отсутствие миграционной модели вплоть до 2004 года; решение миграционных и интеграционных проблем по мере их поступления; нацеленность на привлечение высококвалифицированных и квалифицированных специалистов; переход миграционной политики ФРГ в области интеграции от программы работы с иммигрантами к государственной интеграционной политике; введение ограничительных мер в миграционной политике после начала миграционного кризиса; рост требований в сфере интеграции.

The purpose of the study is to determine the key features of the evolution of the German migration policy from 1991 to 2019. Despite the large number of directions in the study of migration policy, both among domestic and foreign researchers, there are currently no works devoted directly to the analysis of the entire evolution of the FRG migration legislation taking into account the latest developments. Therefore, the source base of this work is directly the legislative acts of Germany related to migration and integration policies; statistical yearbooks of Federal Statistical Office of Germany; pre-election party programs of those parties that received seats in the Bundestag as a result of the elections, as well as the media. As part of the study, changes in the migration and integration legislation of the Federal Republic of Germany over the past three decades are analyzed, and the main factors affecting this process are also considered. As a result of the study, the author concludes that the migration policy of Germany in the period 1991-2014 coped with the flows of arriving immigrants, but was unprepared for the migration crisis that began in August/September 2015. The German government managed to stabilize the situation only by the beginning of 2018. Based on the work done, six features of the evolution of migration policy were identified: the absence of a migration model until 2004; solving migration and integration problems as they become available; focus on attracting highly qualified and qualified specialists; the transition of the German migration policy in the field of integration from a program of work with immigrants to state integration policy; the introduction of restrictive measures in migration policy after the beginning of the migration crisis; growing requirements in the field of integration.
