Features of the compensation for losses in case of restriction of rights due to the establishment and modification of zones with special conditions of use of territories

Abstract

В своей Выпускной квалификационной работе мной рассматриваются вопросы возмещения убытков при ограничении прав в связи с установлением, изменением зон с особыми условиями использования территорий. С 4 августа 2018 г. действуют изменения в Земельном кодексе РФ, внесенные Федеральными законами от 03.08.2018 № 340-ФЗ и № 342- ФЗ. Данные нормативные правовые акты закрепили правовой режим зон с особыми условиями использования территорий. Одним из важнейших вопросов регулирования данного института является вопрос возмещения убытков тем лицам, чьи права были нарушены путем установления данных зон. Учитывая, что установление (изменение) ЗОУИТ накладывает серьёзные ограничения на правообладателей участков и ОКС, попадающих в соответствующие зоны (обязанность по приведению в соответствие, сносу), естественной является потребность предоставления имущественной компенсации соответствующим лицам. В процессе изучения данной темы возникают некоторые вопросы: какое лицо имеет право заявить о компенсации? Каков предельный размер компенсации, необходимо ли возмещать упущенную выгоду лица или стоит ограничиться только возмещением реального ущерба? Как складывается развитие судебной практики по данному вопросу? На эти и другие вопросы предлагается ответить автору данного исследования.

In my Final qualifying work, I consider the issues of compensation for damages in the case of restriction of rights in connection with the establishment, change of zones with special condition of using the territories. Since August 4, 2018, the amendments to the Land Code of the Russian Federation, introduced by Federal Laws No. 340-FZ and No. 342 - FZ of 03.08.2018, have been in effect. These normative legal acts have established the legal regime of zones with special conditions for the use of territories. One of the most important issues of regulation of this institution is the issue of compensation for damages to those persons whose rights were violated by establishing these zones. Given that the establishment (amendment) of the ZOUIT imposes serious restrictions on the right holders of land plots and OKS that fall into the relevant zones (the obligation to bring them into compliance, demolition), it is natural to provide property compensation to the relevant persons. In the process of studying this topic, some questions arise: which person has the right to claim compensation? What is the maximum amount of compensation, is it necessary to compensate for the lost profit of a person, or should we limit ourselves only to compensation for real damage? How is the development of judicial practice on this issue developing? The author of this study is invited to answer these and other questions.
