Social welfare of healthcare workers during the spread of the novel coronavirus infection (COVID-19)

Abstract

В борьбе с эпидемией новой коронавирусной инфекции медицинские работники, осознающие многочисленные риски как для их здоровья и жизни, так и для благополучия их семей, стойко продолжают исполнять свой профессиональный долг. Вместе с тем во многих ситуациях работники здравоохранения окружены рядом проблем, связанных как с излишней бюрократизацией процесса получения положенных социальных гарантий, исходящей от органов государственной власти и работодателей, так и с невысоким качеством юридической техники издаваемых нормативных правовых актов, затрудняющих их исполнимость в силу многочисленных неясностей и неточностей. В целях совершенствования действующего законодательного регулирования были исследованы особенности регулирования социального обеспечения медицинских работников, проанализирована правоприменительная практика по делам, связанным с данной категорией, а также проведена оценка эффективности принятых мер в области социальной поддержки медицинских работников в период распространения новой коронавирусной инфекции. В заключении делается вывод о том, что разработка исследованного института должна продолжаться и совершенствоваться, как минимум, до тех пор, пока в законодательство не будут внесены должные изменения.

In the fight against the epidemic of the new coronavirus infection, medical workers, who are aware of the many risks to their health and life, and to the well-being of their families, steadfastly continue to fulfill their professional duty. At the same time, in many situations, healthcare workers are surrounded by several problems associated with both the excessive bureaucratization of the process of obtaining the required social guarantees, emanating from state authorities and employers, and with the low quality of legal technology of the issued normative legal acts, which complicate their enforceability due to numerous ambiguities and inaccuracies. To improve the current legislative regulation, the features of the regulation of social security for medical workers were studied, the law enforcement practice in cases related to this category was analyzed, and the effectiveness of the measures taken in the field of social support of medical workers during the spread of the new coronavirus infection was assessed. It is concluded that the development of the studied institute should continue and be improved, at least, until the necessary changes are made to the legislation.
