The text-forming function of constructions expressing conditionality relations in the text of Russian laws (a case study of the Constitution of the Russian Federation and the Law of the Russian Federation "On Protection of Consumer Rights")

Abstract

Данная работа посвящена выявлению текстообразующих функций конструкций со значением обусловленности в тексте закона. Материалом исследования являются тексты Конституции РФ и Закона РФ «О защите прав потребителей». В теоретической части данной работы представлен ряд важных, спорных и актуальных проблем в теории текста, исследовании закона и категории обусловленности. В практической части работы был проведен анализ текстообразующих функций конструкций со значением обусловленности на материале текстах Конституции РФ и ЗоЗПП. В построении текстов Конституции РФ и ЗоЗПП активно действуют конструкции со значением обусловленности, повторяются конструкции, выражающие причинно-следственные, условные, уступительные и целевые отношения. Только условная категория осуществляет полную экспликацию в форме СПП, другие семантические разновидности в основном существуют в предложно-падежной форме с неполной пропозицией. Исследование показывает, что по вариативности и частотности употребления конструкций со значением обусловленности в тексте ЗоЗПП больше чем, в Конституции РФ, что связано с типами ФСТР.

This dissertation is devoted to the identification of text-forming functions of structures with the meaning of conditionality in the text of the law. The research material is the texts of the Constitution of the Russian Federation and the russian federal law “Law on Protection of Consumer' Rights”. In the theoretical part of this work, a series of important, controversial and topical problems in the theory of the text, the study of the law and the category of conditionality were developed. In the practical part of the work, the analysis of the text-forming functions of structures with the meaning of conditionality was carried out on the material of the texts of the Constitution of the Russian Federation and the russian federal law “Law on Protection of Consumer' Rights”. In the construction of these texts constructions with the meaning of conditionality are actively operating, constructions expressing causal, result, conditional, concessive and purpose relationships are repeated. Only the conditional category carries out full explication in the form of the subordinate clause, other semantic varieties mainly exist in noun phrase structures with an incomplete proposition. The study shows that in terms of the variability and frequency of the use of constructions with the meaning of conditionality in the text of the russian federal law “Law on Protection of Consumer' Rights” more than in the Constitution of the Russian Federation, which is associated with the types of the functional-semantic type of speech.
