Analysis of the application of the financial fair play system by UEFA: whether it is a fair tool for regulating the economic activity of clubs

Abstract

В работе были проанализированы основные положения правил финансового «фэйр-плей» УЕФА, касающиеся финансового критерия лицензирования, правила безубыточности, потенциально ограничивающих экономическую деятельность клубов и конкуренцию целом, а также то, как они применяются, что происходит в случае нарушения правил, какими полномочиями обладают органы УЕФА по финансовому контролю, какие инструменты есть у клубов, чтобы избежать санкций даже при недостижении безубыточности. Проанализированы различия на первый взгляд идентичных конструкций добровольного и мирового соглашения. Проанализировано то, как правила финансового fair play влияют на развитие клубов, как они могут с одной стороны стимулировать финансовое оздоровление клубов, а с другой стороны ограничивать варианты развития. Дан ответ на вопрос, регулируется ли спортивная сфера европейским законодательством или спортивные организации обладают полной автономией в нормотворчестве.

The research paper analyzed the main provisions of the UEFA financial fair play rules concerning the financial licensing criteria, the break-even rules that potentially restrict the economic activities of clubs and competition in general, as well as how they are applied, what happens in case of violations of the rules, what powers the UEFA financial control bodies have, what tools clubs have to avoid sanctions even if they do not reach break-even. The differences between the seemingly identical constructions of a voluntary agreement and a settlement agreement are analyzed. The article analyzes how the rules of financial fair play affect the development of clubs, how they can, on the one hand, stimulate the financial recovery of clubs, and on the other hand, limit the development options. The answer is given to the question whether the sports sphere is regulated by European legislation or whether sports organizations have full autonomy in rule-making.
