The procedure of mediation in entrepreneurial cases in Russia and abroad

Abstract

В своей работе, автором изучено законодательное регулирование медиации в Российской Федерации и других государствах. В частности, проведен сравнительный анализ развития и использования процедуры медиации в предпринимательских спорах в Российской Федерации и в зарубежных странах, изучен опыт использования процедуры на территории стран СНГ и странах дальнего зарубежья. Кроме того, исследованы актуальные проблемы правового регулирования и предложены возможные изменения или дополнения в законодательство о медиации для более эффективного использования медиации в целях разрешения предпринимательских конфликтов, в том числе на основе зарубежного опыта.

In his work, the author studied the legal regulation of mediation in the Russian Federation and other states. In particular, a comparative analysis of the development and use of the mediation procedure in business disputes in the Russian Federation and in foreign countries was carried out, the experience of using the procedure on the territory of the CIS countries and non-CIS countries was studied. In addition, the current problems of legal regulation are investigated and possible amendments or additions to the legislation on mediation are proposed for the more effective use of mediation in order to resolve business conflicts, including on the basis of foreign experience.
