Indexation of sums awarded by the court

Abstract

Целью данной выпускной квалификационной работы являлось составление характеристики системы регулирования института индексации присужденных судом денежных сумм в Российской Федерации и определение природы индексации присужденных судом денежных сумм. Для достижения цели решались следующие задачи: анализ законодательного регулирования института индексации присужденных судом денежных сумм, анализ позиций высших судов по вопросу порядка применения института индексации присужденных судом денежных сумм, анализ доктринальных позиций об институте индексации присужденных судом денежных сумм, определение природы индексации, определение понятия индексации присужденных денежных сумм. Анализ доктринальных позиций и позиций правоприменителей, касающихся института индексации присужденных судом денежных сумм, выявил многочисленные позиции, отсутствие единой судебной практики, фундаментальные правовые ошибки в доминирующих позициях, в том числе, в позициях высших судов. В процессе исследования был сделан вывод об регулятивной природе индексации присужденных денежных сумм и о необходимости реформирования регулирования смежных институтов в случае, если законодатель изменит природу индексации присужденных денежных сумм на охранительную.

The purpose of this final qualifying work was to compile a characteristic of the system of regulation of the institution of indexation of the sums awarded by the court in the Russian Federation and to determine the nature of the indexation of the sums awarded by the court. To achieve this goal, the following tasks were solved: analysis of the legislative regulation of the institution of indexation of sums of money awarded by the court, analysis of the positions of higher courts on the procedure for applying the institution of indexation of money awarded by the court, analysis of doctrinal positions on the institution of indexation of money awarded by the court, determination of the nature of indexation, definition of the concept of indexation the sums of money awarded. An analysis of the doctrinal positions and positions of law enforcement officers regarding the institution of indexation of sums of money awarded by the court revealed numerous positions, the lack of a unified judicial practice, fundamental legal errors in dominant positions, including the positions of higher courts. In the course of the study, a conclusion was drawn about the regulatory nature of the indexation of the awarded sums of money and the need to reform the regulation of related institutions in the event that the legislator changes the nature of the indexation of the awarded sums of money to a protective one.
