Forensic features of the investigation of crimes in the trafficking in precious stones

Abstract

Деятельность, связанная с добычей, обработкой и обращением драгоценных камней на специализированных рынках находится под строгим государственным контролем и подчинена требованиям значительного числа отраслевых нормативно–правовых актов. Это исторически сложившаяся закономерность, обусловленная значимостью особо ценных природных богатств для экономического благосостояния государства. Одновременно с этим материальная ценность драгоценных камней обуславливает криминальную активность в сфере их незаконного оборота. Идея завладения драгоценными камнями, в целях получения последующей материальной выгоды, является привлекательной для искаженного преступного сознания. В настоящее время распространенность преступлений, связанных с незаконным оборотом драгоценных камней, характеризуется стабильно высокими показателями. В этой связи, разработка актуализация криминалистической методики расследования преступлений в сфере оборота драгоценных камней является необходимой. Особого внимания заслуживают вопросы и криминалистической характеристики преступных деяний в сфере оборота драгоценных камней выявление специфики производства следственных действий и использования специальных знаний по данной группе преступных деяний. Тем самым тема диссертационного исследования характеризуется актуальностью высокой теоретической и практической значимостью.

Activities related to the extraction, processing and circulation of precious stones in specialized markets are under strict government control and are subject to the requirements of a significant number of industry regulations. This is a historically formed pattern due to the importance of especially valuable natural resources for the economic well-being of the state. At the same time, the material value of precious stones determines criminal activity in the sphere of their illegal turnover. The idea of ​​taking possession of precious stones in order to obtain subsequent material gain is attractive to a distorted criminal consciousness. Currently, the prevalence of crimes related to the illegal circulation of precious stones is characterized by consistently high rates. In this regard, the development of the actualization of the forensic methodology for the investigation of crimes in the sphere of the circulation of precious stones is necessary. Special attention should be paid to the issues and the forensic characteristics of criminal acts in the sphere of the circulation of precious stones, the identification of the specifics of the production of investigative actions and the use of special knowledge on this group of criminal acts. Thus, the topic of the dissertation research is characterized by the relevance of high theoretical and practical significance.
