International legal aspects of construction, laying and operation of marine transboundary pipelines

Abstract

Цель работы состоит в выявлении современного международно–правового режима трансграничных трубопроводов, проблем правового регулирования и функционирования трубопроводного транспорта, а также предложить рекомендации по их разрешению, определить право, применимое к трансграничному газопроводу – «Северный поток - 2» и сопутствующих правовых проблем при его строительстве. В работе, дано понятие «трансграничный трубопровод», определен правовой режим трансграничных трубопроводов, рассмотрены положения Конвенции ООН по морскому праву 1982 г. затрагивающие регулирование морских трубопроводов, рассмотрено правовое регулирование трансграничного трубопровода «Северный поток - 2»

The aim of the work is to identify the modern international legal regime of cross-border pipelines, problems of legal regulation and functioning of pipeline transport, as well as to propose recommendations for their resolution, to determine the law applicable to the cross-border gas pipeline - "Nord Stream - 2" and related legal problems during its construction ... In the work, the concept of "transboundary pipeline" is given, the legal regime of transboundary pipelines is defined, the provisions of the United Nations Convention on the Law of the Sea 1982 affecting the regulation of offshore pipelines are considered, the legal regulation of the Nord Stream 2 transboundary pipeline is considered.
