Prohibitions and restrictions in international trade

Abstract

Тема выпускной квалификационной работы: запреты и ограничения в международной торговле. Целями написания данной работы является всестороннее изучение запретов и ограничений в международной торговле, их видов, форм и значения для современной торговой системы. Отдельное внимание уделяется их практическому применению с учетом положений и правил, сформированных в рамках ВТО и ЕАЭС, а также эффект воздействия на международную торговлю. Также перед автором стоит цель найти возможные подходы совершенствования действующих ограничений и запретов в международной торговле, опираясь на практику их применения. Предметом исследования работы является: национальные нормативно-правовые акты, нормы международного права, научная юридическая литература, практика органа по разрешению споров ВТО. Данная работа состоит из: содержания, введения, двух глав, раскрывающих основные вопросы использования и регулирования запретов и ограничений, заключения и списка использованной литературы. Первая глава работы посвящена изучению системы запретов и ограничений в торговле. Во второй главе рассматриваются правила и практика применения нетарифных мер в торговле.

The theme of final qualifying master paper: prohibitions and restrictions in international trade. The main reason of writing this work is a comprehensive study of prohibitions and restrictions in international trade, their types, forms and values for the modern trading system. Special attention is paid for their practical application subject to the provisions and the rules established under the WTO and the EAEU, as well as the impact on international trade. The author also has a goal to find possible approaches to improving existing restrictions and prohibitions in international trade, based on the practice of their application. The subject of the research work is: national regulations, international law, scientific legal literature, the practice of the WTO dispute resolution body. This work consists of content, introduction, two chapters, revealing the main issues of the use and regulation of prohibitions and limitations, conclusion and references. The first chapter is devoted to the study of the system of prohibitions and restrictions on trade. The second chapter consists analysis of the rules and practices of non-tariff measures in trade.
