Civil identity and human rights: theoretical and legal analysis

Abstract

В работе предпринята попытка осмысления связи прав человека и гражданской идентичности. Рассматриваются две отправные точки анализа соотношения гражданской идентичности и прав человека: личностная и социальная. Личностный аспект гражданской идентичности и прав человека проявляется через категорию свободы. Общественная связь гражданской идентичности и прав человека заключается в осознании прав человека и предъявления требований к государству, к правопорядку к их легитимации. Правовая легитимность – это связующее звено гражданской идентичности и прав человека. Она являет себя в двух реальностях: реальности права, существуя в качестве права-требования и реальности позитивации права, то есть, как рефлексия на закрепленные права человека. Объединить гражданскую идентичность и права человека представляется возможным в контексте дискурсивной теории, что можно проиллюстрировать на уровне рационального дискурса в теориях дискурсивной демократии Р. Алекси и делиберативной демократии Ю. Хабермаса.

The research attempts to understand the connection between human rights and civic identity. Two starting points for analyzing the relationship between civic identity and human rights are considered: personal and social. The personal aspect of civic identity and human rights manifests itself through the category of freedom. The social connection between civic identity and human rights lies in the awareness of human rights and the presentation of demands to the state, to the rule of law for their legitimation. Legal legitimacy is the link between civic identity and human rights. It manifests itself in two realities: the reality of law, existing as a right-demand and the reality of positive law, that is, as a reflection on fixed human rights. It is possible to combine civic identity and human rights in the context of a discursive theory, which can be illustrated at the level of rational discourse in the theories of discursive democracy R. Aleksi and deliberative democracy J. Habermas.
