The European Union's Third energy package and access to gas transportation and gas distribution networks with regard to article V of the GATT and Energy Charter 1991

Abstract

Данная выпускная квалификационная работа посвящена рассмотрению последнего введенного Европейским парламентом Европейского союза регулирования рынка энергетических ресурсов на территории Евросоюза. Представленное исследование состоит из двух глав. Первая содержит общий анализ части того массива правового регулирование, которое затрагивает Третий энергопакет. Так, в первую очередь, представлено рассмотрение антимонопольного законодательства на примере изучения конкурентного права Российской Федерации, Евразийского экономического союза, Содружества независимых государств, а также самого Евросоюза. Далее исследование затрагивает инвестиционные соглашения, заключаемые между государствами касательно торговли энергетическими ресурсами. В заключение первой главы представлен анализ основного действующего регулирования транзитных передвижений. Так подробно были рассмотрены соответствующие регулирования в статье V ГАТТ, а также в статье 7 Договора к Энергетической хартии в совокупности с проектом Транзитного протокола к Договору. Вторая глава работы была полностью посвящена анализу самого Третьего энергопакета. После подробного рассмотрения содержания нормативно-правовых актов, из которых состоит третий энергопакет, их положения были проанализированы на предмет соответствия международным обязательствам, взятым на себя как самим Евросоюзом, так и его отдельными государствами. Далее уделяется внимание судебной практике, сложившейся на данный момент в отношении Третьего энергопакета, в частности, было исследовано дело, находящееся на рассмотрении в Органе по разрешению споров ВТО, которое было инициировано Российской Федерацией.

These final theses concern the latest European Union regulation of the energy market on the territory of the European Union, introduced by the European Parliament. The present research consists of the two main chapters. The first contains a principal analysis of the part of the array of legal regulation that is affected by the Third energy package. Thus, first of all, consideration of the antimonopoly legislation is presented on the example of studying the competition law of the Russian Federation, the Eurasian Economic Union, the Commonwealth of Independent States, and the European Union itself. Further, the research concerns upon investment agreements concluded between states on the international trade of the energy recources. The conclusion of the first chapter is an analysis of the main current regulation of 'traffic in transit'. Thus, the relevant regulation in Article V GATT, as well as in Article 7 Energy Charter Treaty, in conjunction with the draft of the Transit Protocol to the Treaty, were examined in detail. The second part of the theses was entirely devoted to the analysis of the Third Energy Package . After a detailed review of the contents of the regulatory and legal acts that constitute the Third Energy Package, their provisions were analysed for compliance with international obligations undertaken by both the EU and separately by its member-states. Further the jurisprudence that has developed at the moment with regard to the Third Energy Package is presented, in particular, the case pending before the WTO DSU, which was initiated by Rissia, was examined.
