Problems of providing and receiving patient information as part of obtaining informed voluntary consent

Abstract

Выпускная квалификационная работа посвящена анализу проблем, возникающих при предоставлении информации, и проблем восприятия пациентом медицинской информации в рамках получения информированного добровольного согласия. Исследованы причины и факторы, влияющие на возникновение таких проблем с точки зрения действующего правового регулирования. Проанализированы критерии юридической действительности согласия на медицинское вмешательство с учетом судебной практики ЕСПЧ и судов РФ. Также исследован вопрос отзыва информированного добровольного согласия. В заключении представлены конкретные пути решения проблем.

The final qualifying work is devoted to the analysis of problems arising in the provision of information, and the problems of the patient's perception of medical information in the framework of obtaining informed voluntary consent. The reasons and factors influencing occurrence of such problems from the point of view of the operating legal regulation are investigated. The criteria of legal validity of consent to medical intervention taking into account the court practice of the ECHR and the courts of the Russian Federation are analyzed. The issue of recalling of informed voluntary consent was also investigated. In conclusion, specific ways of solving problems are presented.
