Characteristics of the legal status of permanent missions in Russian tax law

Abstract

В работе рассматриваются основы статуса постоянного представительства: понятие, признаки и виды постоянного представительства иностранной организации; затрагиваются проблемы толкования вспомогательного и подготовительного характера деятельности, проблемы, связанные с применением института зависимого агента и строительной площадки. Также рассматриваются проблемы существования института постоянного представительства в условиях цифровой экономики, а также предлагаемые направления разрешения этих проблем.

The paper considers the foundations of the status of permanent establishment: concepts, features and types of permanent representation of a foreign organization; as well as problems associated with the interpretation of the auxiliary and preparatory activities and use of the institution of a dependent agent and construction site. Also, the problems of the existence of the institute of permanent establishment in the digital economy are considered, as well as the proposed solutions for these problems.
