Assessment of the proportionality of the limitation of the rights of citizens in the practice of the Constitutional Court of the Russian Federation

Abstract

Права человека, сущностную основу которых составляют такие высшие ценности, как свобода, равенство и справедливость, имманентно содержат в себе необходимость в ограничение. Получив позитивное закрепление в актах высшего конституционного порядка, права человека попали в сферу деятельности органов конституционной юстиции, которые осуществляют контроль-надзорные функции в целях защиты конституционного строя, прав и свобод человека и гражданина. Оценка соразмерности ограничения прав граждан одно из важнейших полномочий Конституционного Суда Российской Федерации. Основным элементом данной оценки – является принцип соразмерности, который раскрывается через определенный набор критериев, которые должны быть соблюдены законодателем в процессе осуществления нормотворческой деятельности, а Конституционном Судом Российской Федерации, в последствии, оценены в целях выявление возможных нарушения прав и свод человека и гражданина. А такое нарушение должно быть предотвращено путем привлечения к конституционно-правовой ответственности в целях восстановления основ конституционного строя и прав человека.

An assessment of the proportionality of the limitation of the rights of citizens is one of the most important powers of the Constitutional Court of the Russian Federation. The main element of this assessment is the principle of proportionality, which is revealed through a set of criteria that must be observed by the legislator in the process of norm-setting activities, and the Constitutional Court of the Russian Federation is subsequently assessed in order to identify possible violations of rights and the vault of a person and citizen. And such a violation should be prevented by bringing to constitutional legal responsibility in order to restore the foundations of the constitutional order and human rights.
