The online entertainment industry in the context of the World Trade Organization: trends in legal regulation

Abstract

В рамках данного труда внимание исследователя сосредоточено на нетипичном для права Всемирной торговой организации предмете. В настоящее время современные технологии в значительной степени опережают развитие правового регулирования данной сферы. Однако это не повод отказываться от применения к вновь возникающим отношениям имеющихся правил и норм международной торговли. Ввиду нарастающих оборотов международной торговли посредством использования сети Интернет, индустрия онлайн-развлечений как одна из сфер торговых отношений, которые возникли благодаря широкому распространению и использованию Интернета, вызывает особый интерес. Именно поэтому представляется необходимым рассмотреть тенденции правового регулирования применимо к данной области. В работе анализируются следующие объекты индустрии онлайн-развлечений: онлайн-реклама, видеоигры, виртуальная реальность и аудиовизуальные сервисы. Правовую основу исследования составляют соглашения, формирующие право ВТО. Анализируется практика государственного вмешательства в индустрию онлайн-развлечений на примере России и Китая. Кроме того, в заключительном параграфе работы рассматривается проблематика локализации персональных данных на национальном уровне.

Within the framework of this work, the researcher's attention is focused on an extraordinary subject for the law of the World Trade Organization. Nowadays, modern technologies are largely ahead of the development of legal regulation related to this sphere. However, this seems not to be a reason to refuse the application of the existing rules and norms of international trade to the newly emerging relations. Considering the growing turnover of the international trade through the use of the Internet, the online-entertainment industry is one of the areas that have arisen particular interest due to the widespread use of the Internet. It is important to consider the trends of legal regulation applicable to this field. The following items of the online-entertainment industry are analyzed in this paper: online-advertising, video games, virtual reality and audiovisual services. The legal basis for the analysis is the agreements that form the law of the WTO. The practice of state intervention in the online-entertainment industry is analyzed by the examples of Russia and China. In addition, the final paragraph of the paper reviews the problem of localization of personal data at the national level is considered.
