Creation of the International Criminal Court and legal issues of responsibility for international crimes

Abstract

The article considers from the theoretical and practical standpoints legal issues of responsibility for international crimes. In the first part author considers some questions of creation and activity of the International Criminal Court (ICC) — major institution of international criminal justice. Then author based on the Statute and judicial practice came to the essential conclusion that, when holding senior government officials responsible for the commission of international crimes and convicting of these persons, the ICC thereby is also giving an indirect negative international legal appreciation both to official bodies and to the State which admitted to the misconduct of its representatives.
